3 . The City shall acquire all rights of access and easements <br /> 410 and provide for the replacement of trees removed under the <br /> construction phase of this project . <br /> 4 . The County and City shall equally participate in the , costs <br /> of this project including, construction costs, administrative, design <br /> and construction engineering costs and the costs of rights of access <br /> and tree replacement . <br /> 5 . Upon completion of the project the County shall own and <br /> maintain the 10 'x5' concrete box culverts known as Bridge #62522 and <br /> the City shall own and maintain the 58" arch storm sewer trunk line. <br /> 6 . Upon completion of this project the City shall, under <br /> separate contract or by their own forces, inspect, clean and make <br /> necessary repairs to the existing Long Lake Road and 14th Street N.W. <br /> storm sewer trunk lines and and shall provide for additional <br /> catch basin capacity on 14th Street N.W. to the extent that bypass <br /> flow shall not drain onto Long lake Road. <br /> 7 . The City shall not seek reimbursement from the County for <br /> costs incurred in performing the work identified under paragraph 6 . <br /> 8 . Upon completion of this project the County shall, under <br /> separate contract or by their own forces, inspect, clean and make <br /> necessary repairs to the existing catchbasins and lateral storm sewer <br /> 0 lines directly serving the paved surface of Long Lake Road. <br /> 9 . The County shall not seek reimbursement from the City for <br /> costs incurred in performing the work identified under paragraph 8 . <br /> 10 . Upon the award of contract the County shall invoice the <br /> City for costs incurred in performing the preliminary engineering <br /> duties . The City shall credit 50% of the total preliminary <br /> engineering costs towards the County' s share of the construction <br /> contract costs. <br /> 11 . Upon the completion of the construction contract items of <br /> work the County shall invoice the City for costs incurred in <br /> performing the construction engineering duties . The City shall credit <br /> 50% of the total construction engineering costs towards the County' s <br /> share of construction contract costs . <br /> 12 . Following the receipt of the construction engineering <br /> invoice and the replacement of trees the City shall bill the County <br /> for 50% of the construction contract and tree replacement expenses <br /> less amounts previously credited. The County shall reimburse the City <br /> within sixty days following the receipt of the invoice. <br /> 13 . Any facilities modified or added to those provisions <br /> presently made in the plans and specifications may be incorporated in <br /> the construction contract by supplemental agreement and shall be paid <br /> 41, for as specified in the supplemental agreement . <br /> 14 . The City and the County agree to indemnify each other and <br /> 96012-2 <br />
