Any payments required to be paid, and all notices required to be rendered by LESSEE to LESSOR <br /> shall be delivered to LESSOR at: 22010 Cedar Drive, N.W., Cedar, Minnesota, 55011 <br /> SATELLITE DISH <br /> This Lease is contingent upon LESSEE'S ability to obtain approval from representatives of <br /> Hughes Satellite (Hughes) that a satellite dish can be installed to the Building or affixed to the <br /> property, without material damage, to make the receiver functional under terms agreeable to both <br /> parties. If approval is not given by Hughes or its representatives, no later than Nobember 15, <br /> 1996 this Lease shall be null and void. <br /> LESSEE shall have the privilege, at any time during the Lease Term and at any time before <br /> vacating the Premises, of installing to the Building or affixing to the property on which the <br /> Building is located wherein LESSEE is in possession, a roof or pole mounted satellite receiver and <br /> all accompanying equipment to make said receiver functional. LESSEE shall have reasonable <br /> access to the roof or other areas as deemed necessary in order to maintain, install, repair, remove <br /> or modify the satellite receiver and all accompanying equipment at any time during the Lease <br /> Term. LESSEE must remove the satellite receiver and repair any damage to the Building or <br /> property within thirty (30) days of any termination of this Lease due to the removal of the <br /> receiver. <br /> LESSEE shall indemnify and hold LESSOR harmless for all damage or injury that results from the <br /> negligence of LESSEE due to the installation and/or use of the satellite receiver. LESSEE shall <br /> have the privilege at any time to remove the satellite receiver and shall repair any damage caused <br /> thereby. <br /> 4. OCCUPANCY AND COMMENCEMENT OF TERM <br /> In the event the Premises are ready for occupancy prior to December 1, 1996, ("Commencement <br /> Date") LESSOR will allow LESSEE to take early occupancy. All terms and conditions of this <br /> Lease shall be in effect during any said early occupancy period. Base rent and other charges for <br /> any early occupancy period shall be prorated. Additionally, if LESSEE shall occupy the Premises <br /> prior to the Commencement Date of this Lease, with LESSOR'S consent, all the provisions of this <br /> Lease shall be in full force and effect as soon as LESSEE occupies the Premises and the Lease <br /> expiration date shall not change. <br /> If the LESSOR shall be unable to give possession of the Premises on the Commencement Date for <br /> any reason except that caused solely by LESSEE, then the rent shall not commence until <br /> possession of the Premises is given and all improvements to be made by LESSOR are substantially <br /> complete, and acceptable to LESSEE. Additionally, in the event that the Premises are not made <br /> substantially complete, and reasonably acceptable to LESSEE within thirty (30) days after the <br /> Commencement Date, LESSEE may, at its option, cancel this Lease, upon written notice to <br /> LESSOR, without liability to LESSOR and this Lease shall become null and void. In the event <br /> LESSOR is unable to give possession on the Commencement Date, and LESSEE does not elect to <br /> cancel this Lease, the expiration date shall be extended from the actual date of occupancy in <br /> accordance with the total lease term specified in the Lease. <br /> EARLY TERMINATION <br /> Notwithstanding anything to the contrary contained elsewhere in this Lease, it is expressly <br /> understood and agreed between the parties hereto that LESSEE is granted an option to cancel this <br />
