HEAD'S APPROVAL: <br /> MANAGER'S REVIEW/RECOMMENDATION: <br /> No comments to supplement this report Comments attached.. <br /> EXPLANATION/SUMMARY (attach supplemental sheets as necessary) <br /> The City acquired the Day and Plocienik properties through the use of eminent domain as part of the Lakeview Business <br /> Park redevelopment project. A three member court-appointed commission was given the task of establishing what the City <br /> should pay as compensation for the acquisition of these properties. The commissioners have reached their decision and <br /> have awarded $455,000 or$2.25/sf for the Day property and$595,000 or$2.50/sf for the Plocienik property. <br /> With regards to the Day property,the award represents approximately a 40%/60% split in favor of the City,between the <br /> City's estimated value of the Day property and the property owner's estimate of value. The City's estimate of value was <br /> $355,000 and the owners estimate was $600,000. <br /> filblith regards to the Plocienik property,the award is approximately a 50%/50% or equal split between the City's estimated <br /> value of the Plocienik property and the property owner's estimate of value. The City's estimate of value was $471,000 <br /> and the owners estimate was $715,000. <br /> The City attorney and staff are recommending City Council approval of these awards assuming the property owners do not <br /> appeal the awards. Both the City and the property owners have the right to appeal if they so choose. An appeal would need <br /> to be filed no later than March 20, 1997. As of the writing of this staff report we are not aware that either property owner <br /> intends to appeal.
