HEAD'S APPROVAL: <br /> MANAGER'S REVIEW/RECOMMENDATION• <br /> No comments to supplement this report Comments attached <br /> EXPLANATION/SUMMARY (attach supplemental sheets as necessary) <br /> At the August 7, 1998,City Council meeting the City Council dropped the proposed Kari Lane/Long Lake Road Relief <br /> Storm Sewer Project and rejected all bids because most of the affected residents refused to sign covenant forms to restrict <br /> future filling of the low backyard area. The filling restricting are necessary to protect the low homes from flooding and <br /> Council was not willing to proceed with the relief storm sewer project without the covenants in place. <br /> Since the August 7, 1998, Council meeting, staff has continued to work with the residents and have now obtained signed <br /> covenants or committments to sign from five of the seven properties,representing approximately eighty percent of the low <br /> backyard area. The two properties which have not signed are located farthest to the south of the impacted area and have the <br /> least impact on the area desired to be protected. The properties excuting the protective covenants include: <br /> 1394 Kari Lane 1393 16th Avenue NW <br /> 1354 Kari Lane 1365 16th Avenue NW <br /> 1314 Kari Lane <br /> ile have also contacted the original low bidder, Thomas and Sons Construction, and they are still willing to sign a contract <br /> to construct the project for the original bid amount of$264,218.30. The project should still be able to be completed this <br /> fall with the exception of the final bituminous surfacing which,due to the loss of time,will have to be postponed until the <br /> spring of 1999. <br /> Based on the fact that we now have covenants in place that will restrict future filling of eighty percent of the Iow backyard <br /> area we are recommending that Council reconsider and approve the relief storm sewer project and authorize the execution <br /> of a contract with Thomas and Sons Construction. <br /> The original bids received July 20, 1998,for the Kari Lane/Long Lake Road Relief Storm Sewer,Project 97-13,were: <br /> Thomas and Sons $264,218.30 <br /> Park Construction $270,333.30 <br /> Barbarossa and Sons $273,178.41 <br /> The proposed funding for the project is 50%Ramsey County from County State Aid Highway funds, 5% from Municipal <br /> State Aid Street funds and 45%from the City Storm Water Utility fund. <br /> RECOMMENDATION <br /> To Reconsider and approve the Kari Lane/Long Lake Road Relief Storm Sewer, Project 97-13,and authorize the execution <br /> of a contract with Thomas and Sons Construction in the amount of the competitive bid received on July 20, 1998, said <br /> amount of bid being $264,218.30, subject to receiving the executed protective covenants from the five properties indicated <br /> Wove. <br /> 1/?•1..4720-4./ <br /> Leslie J.
