HEAD'S APPROVAL: Kevin Locke,Director of Community Development <br /> MANAGER'S REVIEW/RECOMMENDATION: <br /> No comments to supplement this report t Comments attached <br /> EXPLANATION/SUMMARY (attach supplemental sheets as necessary) <br /> To consider a request for a site plan review and a side yard setback variance for the purpose of tearing down the existing <br /> PDQ convenience grocery/gasoline sales facility and constructing a new facility with a canopy. <br /> The variance requested is to the City's required side yard setback for green space of 25 feet adjacent to residential <br /> property. The subject property abuts an apartment complex to the west. PDQ gains access from this property to the west <br /> off of County Road D over an easement that is held by PDQ for access(said easement is attached as an exhibit). <br /> Therefore, PDQ is unable to provide the necessary setback due to the fact that the property line is located in the middle of <br /> the existing drive aisle and gas pump. <br /> FINDINGS <br /> • • Section 8-010, Site Plan <br /> • Section 5-250, Service station canopies <br /> • Section 8210,Variance <br /> • Section 11-020,Parking Standards <br /> PAST ACTION <br /> • On September 16, 1998,the Planning Commission held a public hearing and recommended approval of VN-320 <br /> and LP-345. (Vote: 6-0) <br /> RECOMMENDATION <br /> Motion to WAIVE THE READING AND ADOPT THE ATTACHED RESOLUTION APPROVING VN-320. <br /> Motion to APPROVE LP-345 SUBJECT TO THE FOLLOWING CONDITIONS: <br /> 1. Perimeter curbing must be installed per the attached site plan. <br /> 2. All off-street parking and drive areas be paved with a bituminous surface. <br /> 3. All off Street parking stalls shall be marked with white or yellow painted lines not less than four(4)inches <br /> wide. <br /> 4. The Autumn Purple Ash shall be replaced with either Summit Ash or Green Spire Linden. All other <br /> Landscaping shall be installed per the proposed Landscape Plan. <br /> 5. Provision of a bond or letter of credit in the amount equal to 100% of the cost to install landscaping,curbing <br /> and paving to ensure that these items are installed per the approved lans. <br /> A , <br /> • <br /> Cary .
