HEAD'S APPROVAL: Kevin Locke, Director of Community Development <br /> MANAGER'S REVIEW/RECOMMENDATION: <br /> No comments to supplement this report ^ 1, J_- Comments attached <br /> EXPLANATION/SUMMARY (attach supplemental sheets as necessary) <br /> To consider a Zoning Ordinance Amendment to Chapter 5 of the City's Zoning Ordinance to establish automotive service, <br /> service stations, service garage, and convenience gasoline establishments as uses allowed by Special Permit. <br /> Current regulations within the B-3, General Business zoning district allows automotive service, service stations, service <br /> garage (excluding automotive body shops) as a Permitted Use under Section 5-220 of the Zoning Ordinance. Given the <br /> significant increase in site plan reviews the City has received in regard to upgrades of to these types of uses such as PDQ, <br /> Super America, Amoco, Mobile, Conoco, and Tank-n-Tummy to name a few,the City Council has authorized staff to <br /> prepare an ordinance amendment to regulate these uses under a Special Use Permit, rather than a Permitted Use. By <br /> requiring a Special Use Permit,the City will be in a better position to regulate these operations by placing specific <br /> conditions on approvals regarding such items as landscaping,noise, lighting, outside storage, access or what ever issue <br /> (right be important for each individual instance. <br /> Attached is a draft of the proposed amendment. Please note that automotive service, service stations, service garages are <br /> deleted from the Permitted Use Section and inserted in Section 5-240,Uses by Special Permit. Also,the term convenience <br /> gasoline establishment is added,as it is the most common term for the new type of fueling stations that includes many <br /> accessory uses such as car washes, convenience grocery,bank machines, fast food etc. <br /> PAST ACTION <br /> • On February 16, 1999, The Planning Commission considered the proposed ordinance amendment and <br /> unanimously recommended approval (Vote: 5-0) <br /> RECOMMENDATION <br /> Motion to WAIVE THE READING AND ADOPT THE ATTACHED ORDINANCE AMENDMENT TO SECTIONS 5-220 AND 5-240 OF <br /> THE NEW BRIGHTON ZONING ORDINANCE. <br /> Cary KQTeague, City.Planner <br /> 411 <br /> I:ISHAREDICOUNC ILIREPORTSl19991B-3MEM.WPD <br />
