HEAD'S APPROVAL: Kevin Locke, Director of Community Development <br /> MANAGER'S REVIEW/RECOMMENDATION: <br /> No comments to supplement this report p�' Comments attached <br /> EXPLANATION/SUMMARY (attach supplemental sheets as necessary) <br /> Hiawatha Oil is requesting a site plan review and special use permit to tear down the existing Tank-n-Tummy convenience <br /> grocery/gasoline sales facility and construct a new facility that will include a car wash, canopy and office space. The <br /> special use permit is requested to reduce the setback on the east property line facing I-35W from the required 30 foot <br /> setback to 15 feet per Section 11-020. (f)of the Zoning Ordinance,which allows a 15 foot side street setback by Special <br /> use Permit. <br /> FINDINGS <br /> • Section 8-010, Site Plan <br /> • Section 3-130, Special Use Standards <br /> • Section 11-010,Parking Standards <br /> *AST ACTION <br /> • On February 16, 1999,The Planning Commission considered the special use permit and site plan and unanimously <br /> recommended approval subject to conditions(Vote: 5-0) <br /> RECOMMENDATION <br /> Motion to WAIVE THE READING AND ADOPT THE ATTACHED RESOLUTION APPROVING LP-351 AND SP-210 SUBJECT TO <br /> COMPLIANCE WITH THE FOLLOWING CONDITIONS: <br /> 1. Perimeter curbing be installed around the off-street parking area and drive-aisles. <br /> 2. All off-street parking and drive areas be paved with bituminous surface. <br /> 3. Off-street parking stalls must be striped with white or yellow painted lines,not less than four(4)inches wide. <br /> 4. The landscaping plans shall be installed per the submitted plans dated 1-29-99. <br /> 5. Provision of a bond or letter of credit in the amount equal to 100%of the cost to install landscaping,curbing and paving <br /> to ensure that these items are installed per the approved plans. <br /> 6. The curb cut openings must be reduced to 36 feet wide to comply with the City's minimum requirement. <br /> 7. Canopy lighting for the Convenience Store must be recessed into the canopy so as not to be visible from adjacent <br /> properties. <br /> 8. The car wash exit door must be closed during the operation of the car wash,and may not be opened until all car wash <br /> machinery,including the blowers(dryer),are turned off. <br /> 9. All signage shall be required to meet the provisions of the Sign Ordinance Sections 9-010 through 9-180. <br /> 10. The proposed grading plan shall be subject to review and approval of the City Engineer. <br /> 11. Utility hook ups shall be done per approval of the City Engineer. <br /> 12.
