RESOLUTION NO. <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING FINDINGS OF FACT AND APPROVAL OF AMENDED PUD-6,WHICH INCLUDES <br /> PHASE THREE OF BRIGHTON CORPORATE PARK II. <br /> I <br /> WHEREAS, an application for an amended Planned Unit Development has been made by <br /> Industrial Equities Group; and <br /> WHEREAS,the procedural history of the application for a nonconforming use permit is as <br /> follows: <br /> 1. An application for the amended PUD was filed with the City of New Brighton on May <br /> 28, 1999. <br /> 2. The Planning Commission,pursuant to published and mailed notices, held a public <br /> hearing on June 15, 1999, and all persons present at the hearing were given an <br /> opportunity to be heard. The Planning. Commission unanimously recommended <br /> approval of request subject to conditions. <br /> 3. On June 22, 1999 the City Council considered the proposed amended PUD-6; and <br /> Now,THEREFORE BE IT RESOLVED,the City Council makes the following Findings of Fact in <br /> respect to amended PUD-6, Phase Three: <br /> • 1. The subject site is zoned 1-2,Heavy Industrial. <br /> 2. The overall PUD site is 15.3 acres in size with the Phase Three of the PUD being 6.11 <br /> acres in size. <br /> 3. An additional 1.70 acre lot is added to the overall PUD-6 <br /> 4. The subject site is also identified as the Brighton Corporate Park Il site, part of a large <br /> industrial park which the City began redeveloping in 1988. <br /> 5. The surrounding land uses include industrial uses to the north and west, railroad right- <br /> of-way to the south, and I-35W to the east. <br /> 6. The proposed PUD is consistent with the City's Comprehensive Plan which states the <br /> subject site should be developed as an industrial park with clean, modern,and <br /> attractive facilities, and further encourages the redevelopment of such marginally used <br /> industrial areas with intensive industrial parks having a high level of aesthetic quality. <br /> 7. The building and site design for proposed PUD-6, Phase Three would be compatible <br /> with and compliment surrounding land uses. <br /> BE IT FURTHER RESOLVED,the Planning Commission of the City of New Brighton recommends <br /> approval of amended PUD-6, Phase Three, subject to the following conditions: <br /> 1. Approval and continuing compliance with PUD-6 and PL-253. <br /> 2. The proposed grading plan shall be subject to review and approval of the City Engineer. <br /> 3. Continuing Compliance with Rice Creek Watershed District Permit 96-72. <br /> 4. Perimeter curbing be installed around the off-street parking area and drive-aisles. <br /> • <br /> 5. All off-street parking and drive areas be paved with bituminous surface. <br /> 6. Off-street parking stalls must be striped with white or yellow painted lines,not less than <br /> four(4) inches wide. <br /> 7. The landscaping plans shall be installed per the submitted plans dated May 1999 <br /> 8. Per Section 7-230 h.1 (PUD regulations), building setback for building#5 shall be 25-feet <br /> from the right-of-way for 1st Street NW. A sidewalk shall be provided along 1st Street to <br />
