Other Considerations: None <br /> STAFF COMMENTS <br /> Variance <br /> The applicant is requesting a 26.5 foot front yard setback variance to Section 4-040 of the Zoning <br /> Ordinance,which requires a 30-foot front yard setback for all structures within the R-1A Zoning District. <br /> The purpose of the request is to construct a 22 x 26 foot(572 square foot)detached garage. <br /> In considering an application for a variance,the City must make the following findings: <br /> 1. An undue hardship would be brought upon the applicant, should the variance be denied. <br /> 2. There are unique circumstances related to this site. <br /> The above findings may be made in this situation due to the unique shape(pie shape)of the lot coupled <br /> with the site being located on the corner of two streets with a 30-foot setback required. Additionally,the <br /> applicant has a 25-foot green space boulevard from the lot line to the paved surface of the road due to the <br /> reconfiguration of New Brighton Road which is now called 1st Avenue (a typical residential boulevard in <br /> New Brighton is 10-15 feet wide). Therefore,there is no location in this area of the site in which a <br /> detached garage could be constructed without some type of variance. Also,there are overhead power <br /> lines running from the rear property line to the house, and there is a large area that would have to be filled <br /> . to even out slopes in the back yard if the garage were set further back on the lot.
