HEAD'S APPROVAL: Kevin Locke, Director of Community Development \ <br /> MANAGER'S REVIEW/RECOMMENDATION: <br /> No comments to supplement this report Comments attached <br /> EXPLANATION/SUMMARY (attach supplemental sheets as necessary) <br /> To consider a three (3) lot Minor Subdivision of property located at the southwest corner of 14th Street NW and Silver <br /> Lake Road. The proposed access to Lots B and C (the two southernmost lots) is proposed off of Silver Lake Road. The <br /> applicant originally proposed access to these lots by a 16-foot driveway easement located along the western property line <br /> off of 14th Street NW. However,the Planning Commission recommended that the access come off of Silver Lake Road, <br /> therefore,the applicant has altered the plans. The revision is made due to concerns raised at the Planning Commission <br /> meeting over traffic and noise that would be generated from the shared driveway down the western property line that <br /> would negatively effect residents in adjacent existing single family homes. Access to Lot A is proposed off of 14th Street <br /> NW. The specific plans showing the realigned access points shall be submitted to the Council on Tuesday evening,the <br /> attached plans reflect the original submission. <br /> PAST ACTION <br /> • • On June 15, 1999,The Planning Commission considered the minor subdivision and unanimously recommended <br /> approval subject to conditions(Vote: 6-0) <br /> RECOMMENDATION <br /> Motion to WAIVE THE READING AND ADOPT THE ATTACHED RESOLUTION APPROVING PL-252 SUBJECT TO <br /> COMPLIANCE WITH THE FOLLOWING CONDITIONS: <br /> 1. A GRADING AND DRAINAGE PLAN MUST BE SUBMITTED WITH A BUILDING PERMIT APPLICATION TO ENSURE THAT <br /> ANY GRADING ASSOCIATED WITH THE CONSTRUCTION OF THE TWO HOMES SHALL NOT HAVE ANY NEGATIVE <br /> IMPACTS ON ADJACENT PROPERTIES. <br /> 2. THERE SHALL BE NO BUILDING ENCROACHMENT INTO THE DRAINAGE EASEMENT. <br /> 3. SHARED DRIVEWAY ACCESS SHALL BE OFF OF SILVER LAKE ROAD. <br /> 4. THE APPLICANT SHALL WORK WITH THE CITY'S ENGINEERING DEPARTMENT IN REGARD TO UTILITY HOOK UPS. <br /> 5. A TWENTY-FOOT UTILITY EASEMENT SHALL BE CENTERED OVER SEWER LINE COMING IN OFF OF 14TH STREET. <br /> 6. SUBMITTAL OF A SHARED DRIVEWAY ACCESS EASEMENT/AGREEMENT THAT WOULD HOLD THE LOT OWNERS OF <br /> LOT B&C RESPONSIBLE FOR MAINTENANCE. SAID AGREEMENT SHALL BE SUBJECT TO REVIEW AND APPROVAL <br /> OF THE CITY ATTORNEY. <br /> 7.
