That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort or general welfare. <br />That the special use will not be injurious to the use and enjoyment of other property in <br />the immediate vicinity for the purposes already permitted, nor substantially diminish and <br />impair property values within the neighborhood. <br />That the establishment of the special use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in the <br />district. <br />That adequate utilities, access roads, drainage and/or necessary facilities have been or are <br />being provided. <br />That the special use shall in all other respects conform to the applicable regulations of the <br />district in which it is located. <br />Planning Commission and City Council found all Special Use Permit criteria of Sections <br />30 and Section 8-130 to be met, based on the following findings: <br />The garage will be less than 1,064 SF. <br />The total of all accessory buildings on the property will be less than 1,664 SF. <br />The applicant will construct the garage with materials that will match/compliment the <br />existing home. <br />The applicant will not use the proposed garage for any commercial or home occupation <br />activity. <br />Including proposed garage, the existing garage, and the existing shed the property will <br />comply with the maximum accessory structure allotment of 1,664 SF. <br />All existing setbacks, proposed setbacks, hardcover, heights, and structural coverage <br />requirements comply with the R-1 lot standards. <br />THEREFORE BE IT RESOLVED, that based upon the above findings of fact the application <br />,r a Special Use Permit (SP2012-001) is hereby approved, subject to the following <br />1. 1 he garage is constructed consistent with the plans submitted and attached to this report. <br />2.a exterior materials and colors shall match/compliment the home. <br />3. o commercial or home occupation activity shall be conducted within the proposed garage <br />any other accessory buildings on the property. <br />4. 1 he existing shed is relocated in a manner meeting 5' side and rear yard setbacks. <br />this 22nd day of May, 2012. <br />ATTSf: <br />DaJP A: Maters, Director of Finance <br />and port Services f City Clerk <br />Davejdcobsen, Mayor <br />Deve1opment\5-22-2012\SP2012-00 t (Griffen) - RESOLUTIONAm <br />
