Minnesota Department of Health Grant Agreement This grant agreement is between the State of Minnesota, acting through its Commissioner of the Department of Health ("State") and'The City of New Brighton("Grantee"). Grantee's address is I803 Old Highway 8 NW, New Brighton, Minnesota 56112. Recitals 1. Under Minnesota Statutes §144.1451, the State is empowered to enter into this grant agreement. 2. The State is in need of increasing the number of Minnesotans receiving the oral health benefits of optimally fluoridated drinking water. 3. The Grantee represents that it is duly qualified and will perform all the duties described in this agreement to the satisfaction of the State. Pursuant to Minnesota Statutes section 16B.98, subdivision 1, the Grantee agrees to minimize administrative costs as a condition of this grant. Grant Agreement 1. Term of Agreement 1.1 Effective date !June 1, 2012, or the date the State obtains all required signatures under Minnesota Statutes section 16C.05, subdivision 2, whichever is later. The Grantee must not begin work until this contract is fully executed and the State's Authorized Representative has notified the Grantee that work may commence. 1.2 Expiration date August 31, 20121, or until all obligations have been fulfilled to the satisfaction of the State, whichever occurs first. 1.3 Survival of Terms The following clauses survive the expiration or cancellation of this grant contract: 8. Liability; 9. State Audits; 10.1 Government Data Practices; 10.2 Data Disclosure; 12. Intellectual Property; 14.1 Publicity; 14.2 Endorsement; and 16. Governing Law, Jurisdiction, and Venue. 2. Grantee's Duties The Grantee, who is not a state employee, shall: Replace fluoride pumps,hose and foot valve at treatment plant#1. Comply with the requirements described in Minnesota Statute §144.145 and Rule 4700.0030. These requirements include but are not limited to: • Daily monitoring of water production volume, fluoride chemical consumption, and distribution system fluoride concentration(an MDH interim policy allows municipalities having populations less than 3,300 to record measurements of fluoride feed consumption and distribution system sample analysis results at least once during each calendar week); Page 2 of 12
