RESOLUTION No. <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION APPROVING THE VACATION OF A 10' SANITARY SEWER EASEMENT AS <br /> DESCRIBED PER DOCUMENT No. 1581803 LYING WITHIN 755 4TH STREET NW. <br /> WHEREAS, the City Council, pursuant to published notice, held a public hearing on <br /> June 26, 2012 to consider the vacation. All persons present at the hearing were given an <br /> opportunity to be heard; and, <br /> WHEREAS, Red Pine Investments, LLC, the property owner, made application for the <br /> vacation of the sanitary sewer easement described in Document No. 1581803 lying <br /> within 755 4th Street NW; and, <br /> WHEREAS, City of New Brighton Public Works staff investigated and determined no <br /> public utilities lie within the easement area requested to be vacated; and, <br /> WHEREAS, a section of this easement south of 755 4th Street NW was previously <br /> vacated in 1992; and, <br /> Now,THEREFORE,BE IT RESOLVED,the City Council makes the following Findings <br /> of Fact with respect to the proposed vacation for EV2012-001: <br /> 1. The subject area is zoned I— 1, Light Industrial. <br /> 2. The City of New Brighton has determined the 10' sanitary sewer easement to be <br /> vacated is not serving a public purpose and does not contain any public utilities. <br /> 4. A public hearing was held on June 26, 2011, and all present were given a chance <br /> to be heard. <br /> 5. The legal description of the 10' sanitary sewer easement to be vacated is as <br /> follows: <br /> A strip of land 10 feet wide the centerline of which is described as follows: <br /> Beginning at a point on the West line of the NE 1/4 of Section 29, T 30 N, R 23 W, <br /> said point being 585 feet North of the Southwest corner of said NE 1/4; thence <br /> Easterly 265 feet on a line 585 feet North of and parallel with the South line of <br /> said NE 'A; thence Southerly 405 feet on a line 265 feet East of and parallel with <br /> said West line of NE '/4; thence Southwesterly to a point on the North line of the <br /> South 1140 feet of the SE 1/4 of said Section 29, said point being 155 feet Easterly <br /> of the West line of said SE '/4 and there terminating. <br /> BE IT FURTHER RESOLVED,that the described easement is hereby vacated. <br />
