Ordinance amending <br /> Ordinance No.815. the City Code by <br /> establishing a new <br /> Article 16 to Chapter <br /> City Manager Lotter explained staffhas been working on amending the ordinance for some time and was 15 related to outdoor <br /> before the Council this evening for review and approval. This was a staff initiated request and would establish an <br /> administrative license requirement for holding an outdoor event. The ordinance would address Stockyard <br /> Days,sidewalk sales at retail establishment's, seasonal garden sales along with church celebrations. It was <br /> noted the current ordinance does not permit these types of activities to be held outdoors. She explained the <br /> proposed ordinance would be more permissive and allow for exceptions from certain code requirements <br /> during the event. The proposed ordinance would establish a new Article 16 to Chapter 15 addressing <br /> Licenses within the City Code. The proposed ordinance would establish an administrative license <br /> requirement to hold an event,which would mean no Council approval would be necessary. The ordinance <br /> was split into two sections addressing events for churches,civic functions and charities;with a second section <br /> addressing outdoor sales. A three-day event license would be allowed with retail sales allowed twice a year <br /> for ten consecutive days. Exceptions would be made for garden sales,which would be allowed for ten weeks <br /> per year. All events would have to make application with City staff and additional permits may be required, <br /> such as a liquor license,food license or building permit. Noise would be regulated under the City's Nuisance <br /> Code for all outdoor events. In addition,off-premise signs would be permitted for events. Staff <br /> recommended adoption of the ordinance along with accepting a revision to the 2012 Fee Schedule <br /> establishing a$50 fee for review of the administrative outdoor event license. City Planner Gundlach noted <br /> most Stockyard Days events have already been planned but the events could be licensed under the new <br /> ordinance. <br /> Councilmember Bauman asked for further information on the license approval timeline. City Planner <br /> Gundlach indicated the ordinance does not specify a timeline. <br /> Councilmember Burg questioned what prompted the ordinance amendment. City Planner Gundlach noted <br /> Champs hosted an outdoor event in the past along with the Stockyard Days post parade party. She stated the <br /> ordinance amendment would address all future requests in a fair and equitable manner. <br /> Councilmember Burg was concerned with the$50 administrative fee and did not feel the licensing process <br /> was necessary. City Manager Lotter stated current City Code does not allow for any outdoor event to occur. <br /> The propose code amendment would provide a set of rules for these events to occur legally. The Council <br /> could address the proposed fee and make a recommendation to reduce this rate. <br /> Mayor Jacobsen inquired if the$50 fee was based on staff time. City Manager Lotter noted all staff fees were <br /> associated with the cost to process and review the request. <br /> Councilmember Jacobsen questioned how staff developed the length of time for the event licenses.
