RESOLUTION NO. <br />12-058 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />LUTION MAKING FINDINGS OF FACT AND APPROVING A SPECIAL USE PERMIT AND <br />JCONFORMING USE PERMIT. <br />✓HEIEAS, an application has been made by American Student Transportation of Mounds View, <br />Inc. itor a Special Use Permit and a Nonconforming Use Permit to allow operation of a school <br />bus terminal out of the existing property at 401 15` Street SW, and <br />1HEI tAS, the procedural history of the application is as follows: <br />1. n application for a Special Use Permit was received on June 29, 2012. <br />2. e application was considered incomplete upon submission and a Notice for Further <br />Information letter was sent via email and regular mail on July 9, 2012. <br />3. ' j e Planning Commission, pursuant to published and mailed notices, held a public hearing <br />oh July 17, 2012 and all present were given a chance to freely speak at the hearing. <br />4. 1 he Planning Commission recommended denial on July 17, 2012 due to the concerns <br />garding traffic safety and congestion as outlined in the staff Planning Report & Exhibits <br />ted July 13, 2012. <br />5. T he City Council considered the request on July 24, 2012. <br />/HE AS, the Planning Commission and City Council make the following Findings of Fact with <br />respect to the Special Use Permit (SP2012-002) and Nonconforming Use Permit (NC2012-001): <br />I. e property is zoned I-2, Heavy Industrial. <br />2. 1he property is guided in the Comprehensive Plan for HI, Heavy Industrial. <br />3. e property is legally described as: <br />at part of the North Half of the South Half of the Northeast Quarter of the Northeast <br />jast <br />arter of Section 32, Township 30, Range 23, lying westerly of Interstate Highway 35W <br />lying easterly of the Minnesota Belt Line Railroad, Ramsey County, Minnesota. <br />4. e applicant is proposing to operate a school bus terminal on the property, consisting of at <br />54 big buses and 31 Type -A or smaller special education buses. The proposed Site Plan <br />strates the keeping of 63 big buses and 40 smaller buses and/or vans. <br />5. the school bus terminal would operate buses for Mounds View Schools 167 days of the year, <br />om the hours of 6am to 6pm. <br />6. rhe applicant has submitted information suggesting bus trips in excess of 569 per day. It is <br />ticipated that additional trips would be generated from employees. <br />7. he Planning Report dated July 13, 2012 analyzed several zoning related issues, including <br />f -street parking, screening/landscaping, and lighting and found these criteria to be met. <br />8. Ihe Planning Commission and City Council reviewed the proposal in accordance with the <br />Mowing Special Use Permit conditions of Zoning Code Section 8-130: <br />That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort or general welfare. <br />
