1# That the special use will not be injurious to the use and enjoyment of other property in <br />the immediate vicinity for the purposes already permitted, nor substantially diminish and <br />impair property values within the neighborhood. <br />�.' That the establishment of the special use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in the <br />district. <br />d That adequate utilities, access roads, drainage and/or necessary facilities have been or are <br />being provided. <br />.', That the special use shall in all other respects conform to the applicable regulations of the <br />district in which it is located. <br />9. the Planning Commission found the Special Use Permit criteria of Section 8-130 could not <br />1 e met due to the lack of sufficient information from the applicant that demonstrate traffic <br />Oill not have an adverse impact on traffic circulation, congestion, and safety in the vicinity of <br />1I�e proposed use. These reasons are more accurately documented in the staff Planning <br />)�eport and Exhibits dated July 13, 2012. <br />10. "�he City Council finds there is sufficient evidence in the record to conclude the special use <br />11. trmit criteria of Section 8-130 are met if the conditions below are satisfied. <br />I1.ie Planning Commission and City Council considered the proposed Nonconforming Use <br />ermit in accordance with Zoning Code Section 8-460, which regulates Type 4 <br />Lonconformities and requires one of the following criteria to be met: <br />j The total number of nonconformities is reduced. <br />The impact of any nonconformity upon adjacent premises is reduced to the greatest <br />practical extent. <br />The extent of any nonconformity is reduced where practical. <br />12. he Planning Commission and City Council found the criteria of Section 8-460 to be met as <br />is not practical to eliminate the nonconformity. <br />Now YHEREFoRE BE Pr RESOLVED, that based upon the above findings of fact the application for <br />a Sliccial Use Permit (SP2012-002) and Nonconforming Use Permit (NC2012-001) are hereby <br />approved, subject to the following conditions: <br />. The existing parking lot is striped in accordance with the proposed Site Plan. <br />The existing 8' wood privacy fence shall be maintained, repaired, and replaced as <br />necessary to ensure adequate screening and security is maintained for the proposed use. <br />3. Any installed lighting shall meet the requirements of Zoning Code Section 11-010(6). <br />The applicant is advised that the City Building Official has determined the proposed use <br />of the property constitutes a "change -in -use" and all existing systems will have to be <br />brought up to current code standards. <br />Buses entering and exiting the subject property must make only right hand turns from <br />l' Street SW to Old Highway 8 SW and from Old Highway 8 SW to l' Street SW. <br />2 <br />
