Consideration of Resolution Authorizing Update to Alternative Urban Areawide Review <br />(AUAR) for New Brighton Exchange (Environmental Review Document). Report No. 12- <br />128. Resolution No. 12-046. <br />City Manager Lotter reported that this is the second update to the AUAR. Director of Community <br />Development Grant Fernelius reported that the purpose of the updated AUAR is to provide <br />information to decision -makers and the affected public about changes to the City's 2012 <br />AUAR, create and assess alternative scenarios for redeveloping the New Brighton Exchange <br />that meet current site realities, and outline mitigation strategies to protect human health and the <br />environment. <br />Director Fernelius reported the following specific updates; including reduced development <br />assumptions, and mitigation of environmental issues. A schedule was reviewed, with final <br />review likely being presented to the council in September 2012. Director Fernelius reported <br />that the cost is minimal, as the update has been done internally. <br />Councilmember Burg questioned the cost of the initial AUAR. Director Fernelius responded <br />that originally Ryan Co. completed the AUAR at an approximate cost of $300,000. <br />Councilmember Burg thanked Director Fernelius for completing the update internally, <br />resulting in the cost savings. <br />Motion by Councilmember Bauman, seconded by Councilmember Burg to approve the updated <br />New Brighton Exchange (NBE) Alternative Urban Area -wide Review (AUAR) and mail <br />to the State of Minnesota's Environmental Quality Board (EQB) distribution list. <br />5 Ayes, 0 Nays - Motion Carried <br />2. Consideration of Lease Amendment with Clearwire, LLC regarding Freedom Park <br />Tower. ReportNo. 12-129. <br />'Director of Community Development Grant Fernelius reported that the amendment deals with <br />a dispute between the City of New Brighton and Clearwire, LLC related to the size of the <br />tower, as the constructed tower varied from the approved design. Shortly after the tower was <br />built the city received a call from a resident; at that time it was determined that the constructed <br />tower was wider in diameter than the approved tower.
