Report No. 12-151. Resolution No. 12-049.
City Planner Janice Gundlach reported that the applicant is requesting the vacation of an existing
10' sanitary sewer easement that is located within 755 4th Street NW. The existing property
owner is attempting to sell the property and is requesting the vacation in an effort to move
towards a closing. This easement runs underneath the existing building and does not contain
any utilities. Staff provided published notice of the hearing in the June 6b and June 13th
edition of the New Brighton Bulletin as required. No comments were received regarding the
easement vacation. Public Works recommends the Council approve the vacation of the
easement. Staff noted remnant sections of the easement existing north of the property will
remain.
Councilmember Burg questioned why the entire easement was not vacated at this time.
Planner Gundlach explained that Public Works questioned if utilities did exist in the northern
portion of the lot. Until additional research was completed, the rest of the easement should
remain in place.
'Motion by Councilmember Burg, seconded by Councilmember Samuelson to open the Public
Hearing.
5 Ayes, 0 Nays - Motion Carried
The Pubic Hearing was opened at 6:53 p.m.
Consent Aeenda
t.
