He commented this company had a
great reputation and was one of the largest contractors in the metro area.
Councilmember Burg understood Shafer was a large company but wanted to be assured the City was covered
and that no unwanted material would be brought onto the New Brighton Exchange site.
Councilmember Samuelson asked if additional bids were being sought for this work. Director of Public
Works Wyffels indicated through State Statute the City could spend$100,000 without needing to go out for
competitive bids. He noted a quote was taken from North Pine Aggregate.
Councilmember Samuelson requested further information on the previous lawsuit. Councilmember Burg
discussed the matter in detail.
Mayor Jacobsen thanked Councilmember Burg for bringing this matter to the Council's attention. However,
he was pleased with staffs diligence on the matter and for the language provided in the proposed contract.
He questioned if staff had any concerns on the matter. Director of Public Works Wyffels stated his only
concern was allowing Pulte Homes their due diligence on the New Brighton Exchange site,as it would now
be slightly altered. Staffhas been in contact with Pulte Homes and they supported the concept.
Councilmember Bauman asked if the City still needed another 100,000 cubic yards of soil material. Director
of Public Works Wyffels stated this was the case;more material would be needed in the future. At this time,
the most the City can spend on the item is$100,000.
Councilmember Bauman recommended the Class 7 credit be used to buy more material if available through
Shafer Contracting.Director of Public Works Wyffels indicated this would not be allowed after discussing
the matter further with the City Attorney.
Councilmember Jacobsen inquired how much Class 7 was located on the New Brighton Exchange site.
Director of Public Works Wyffels stated there was approximately 38,000 cubic yards of Class 7.
Councilmember Burg thanked staff working so diligently on this matter and for bringing the proposal to the
Council.
Motion by Councihnember Jacobsen seconded by Councilmember Sameulson to authorize City
Project 12-15,New Brighton Exchange Tract 2 Import Soil Project and authorize the Director of
Public Works to perform the following tasks related to this project:
1.
