November 26, 2012
City Planner Gundlach indicated this site is located directly across the street from the approved
school bus terminal of American Student Transportation at 401 1St Street SW. The bus
terminal garnered much discussion based on the amount of traffic that would be produced -by
the site. The applicant was asked whether the proposed addition would produce additional
truck traffic to the site. The property owner has indicated the proposed addition could result in
two additional semi -truck trips per day, at the greatest. The Public Works Director has
indicated this amount is negligible when compared to the amount of traffic on 1St Street SW
already and a traffic analysis/study would not be necessary.
City Planner Gundlach explained the Zoning Code provides that three conditions be evaluated
when considering approval of a Nonconforming Use Permit. Staff determined the criteria are
met based on the fact the applicant has proof of parking concepts have been submitted
illustrating the site can accommodate the code required amount of stalls needed, the building
and parking setback nonconformities have minimal, if any impact as the encroachment in both
cases is less than two feet; and it would not be practical to eliminate the building and parking
setback nonconformities. Staff indicated the Planning Commission met on November 201h and
unanimously recommended approval of the Site Plan and Nonconforming Use Permit, subject
to the following conditions:
1. The proposed improvements are built in accordance with the plans provided.
2. Implementation of the recommendations contained in the interoffice
Engineering/Public Works and Public Safety memos.
3. The applicant enters into a proof of parking declaration of covenants form to be
satisfactory to the City Attorney prior to release of the building permit.
4. At the time of building permit, the applicant shall produce necessary Rice Creek
Watershed District and MnDOT permits related to storm water management.
Councilmember Bauman thanked City Planner Gundlach for the thorough staff report. She was pleased
Wolkerstorfer was expanding their business. She questioned if the declaration of covenants would be applied
to both present and future owners. City Planner Gundlach stated this was the case and the proof of parking
would only be built if there was a concern in the fiuture.
Councilmember Burg was also pleased a company in New Brighton was expanding.
Councilmexnber Jacobsen asked if there were any parking concerns at this time. City Planner Gundlach
explained there were no parking issues with the site and there were no complaints for the property on file.
Councilmember Samuelson questioned when construction of the addition would begin. Mr. Wolkerstorfer
anticipated this would begin sometime in February of 2013.
Motion by Councilmember Burg, seconded by Councilmember Jacobsen to adopt a Resolution
approving the requested Site Plan and Nonconforming Use Permit subject to the four conditions
recommended by Staff.
5 Ayes, 0 Nays -Motion Carried
Commission Liaison Reports, Announcements and Updates
Dean Lotter
City Manager Lotter reported he would be sending out an email to the Council regarding a
potential meeting to be held in December between the Council and Pulte Homes. Pulte Homes
was interested in purchasing a portion of New Brighton Exchange. He indicated API was
interested in a parcel east of The View, which would be a completely separate issue.
