LEASE AGREEMENT <br /> THIS LEASE AGREEMENT,made and entered into as of this day of February, <br /> 2013,by and between the City of New Brighton,a Minnesota municipal corporation,whose address <br /> is 803 Old Highway Eight Northwest, New Brighton, Minnesota 55112 (hereinafter referred to as <br /> "Landlord") and Julianne Bruce, a Certified Massage Therapist whose address is 400 Tenth Street <br /> Northwest,New Brighton, Minnesota 55112, and Valerie Headrick, a Certified Massage Therapist <br /> whose address is 400 Tenth Street Northwest,New Brighton,Minnesota 55112(hereinafter referred <br /> to as "Tenant"). <br /> WITNESSETH: <br /> ARTICLE I- GRANT AND TERM <br /> 1.1 LEASED SPACE. In consideration of the rents, covenants and agreements herein <br /> reserved and contained as the part of Tenant to be performed,Landlord does hereby lease to Tenant <br /> Room 212 on original building plans; also known as Room 229 (382.5 square feet) in the New <br /> Brighton Community Center located at 400 Tenth Street Northwest, New Brighton, Minnesota, <br /> hereto (hereinafter referred to as the "Leased Space".) A drawing of the leased space is attached <br /> hereto as Attachment One. <br /> 1.2 TERM. The term of this lease and Tenant's obligation to pay rent hereunder shall <br /> commence on March 1, 2013 and shall run until June 30, 2013. Tenant may terminate this lease <br /> prior to June 30, 2013 if a thirty(30) day written notice is provided. <br /> 1.3 USE OF COMMON AREAS. Tenant shall have the non-exclusive right to use the <br /> entry ways, elevators, stairs,hallways, and restrooms of the Community Center. Employees of the <br /> Tenant shall have the non-exclusive right to use the parking areas. Use of the parking areas for over <br /> 25 guests or invitees of the Tenant shall be by approval of the Landlord. Use of the public areas of <br /> the Community Center shall be subject to such rules and regulations for use of such areas as may be <br /> established from time to time by the Landlord. <br /> 1.4 ACCESS TO COMMUNITY CENTER. Tenant, its employees, and invitees shall <br /> have access to the Community Center during all business hours established by Landlord for the <br /> facility. There will be no access during non-business hours to employees and/or invitees of Tenant. <br /> Additionally, Tenant, upon Tenant's request, will be provided keys for access to the leased space. <br /> Tenant shall make no more keys than are provided by Landlord. If Tenant loses keys that were <br /> provided by the Landlord,Tenant will be charged$50 per key lost and$50 per lock. <br /> ARTICLE II- RENT <br /> 2.1 RENT. During the term hereof Tenant agrees to pay to Landlord at 400 Tenth Street <br /> Northwest,New Brighton,Minnesota 55112 or at such place as the Landlord may from time to time <br />
