7.4 SIGNS. No signs, advertisements,placards,or notices shall be placed or painted on
<br /> any part of the Leased Space or the Community Center without the prior written authorization of
<br /> Landlord.
<br /> ARTICLE VIII- DESTRUCTION AND RESTORATION
<br /> 8.1 DAMAGE. If a significant portion of the Leased Space shall be damaged or
<br /> destroyed by any casualty,Landlord shall have the option to rebuild or to terminate this Lease. If the
<br /> Leased Space cannot be repaired and restored within ninety(90)days from the date of the damage,
<br /> then the Landlord has the right to terminate this Lease from the date of such damage or destruction
<br /> by giving a notice to the Tenant. If due to such damage or destruction, Tenant is unable to use the
<br /> Leased Space for 30 days, Tenant shall have the right to terminate this Lease by giving Landlord
<br /> written notice. The obligation to pay rent shall cease as of the date of the casualty and shall not
<br /> commence again until and unless the space is made ready for occupancy.
<br /> ARTICLE IX—WAIVER AND INDEMNITY
<br /> 9.1 WAIVER AND INDEMNITY. (a)Landlord and its officers,council members,mayor,
<br /> and employees shall not be liable to Tenant,or those claiming by,through or under Tenant, for any
<br /> damage or claims,however caused,arising from loss or damage to books,records,computer or other
<br /> electronic equipment, data or media, files, artwork, money, securities, negotiable instruments or
<br /> papers,or any other personal property in the Community Center or Leased Space,the interruption in
<br /> the use of any cellular or wireless communication devices or the interruption in the use of the Leased
<br /> Space, any fire, robbery, theft, assault, or any other casualty, any leakage or bursting of pipes or
<br /> water vessels or any roof or wall leakage or other water damage,in any part or portion of the Leased
<br /> Space or Community Center and Tenant hereby releases Landlord from liability with respect thereto.
<br /> (b)Tenant shall indemnify, defend(at Landlord's request and with counsel approved by Landlord)
<br /> and hold Landlord and its officers, council members, mayor, and employees harmless from and
<br /> against every demand, claim, cause of action,judgment and expense,including,but not limited to,
<br /> reasonable attorneys' fees and disbursements of counsel,whether suit is initiated or not,and all loss
<br /> and damage arising from: (a) any injury, loss or damage to the person or property of Tenant, any
<br /> other tenant in the Community Center,or to any other person rightfully in the Community Center(i)
<br /> occurring in or about the Leased Space,or(ii)caused by the negligence or misconduct of Tenant or
<br /> any of its representatives, employees, visitors, guests or other associated parties, or(iii) resulting
<br /> from the violation of the provisions of this Lease by Tenant or its employees;(b)any loss or damage,
<br /> however caused, to books, records, computer or other electronic equipment, data or media, files,
<br /> artwork,money, securities,negotiable instruments or papers in the Leased Space;or(c)any loss or
<br /> damage resulting from interference with or obstruction of deliveries or access to or from the Leased
<br /> Space. The covenants set forth in this Section shall survive the expiration of the Lease and any
<br /> earlier termination thereof.
