7. T he Planning Commission and City Council reviewed the request to allow utilization of an 8' <br />fence for the kennel, when normally only a 6' fence would be allowed, in accordance with <br />e following Special Use Permit findings of Section 4- 540(3)(F): <br />Ir Are necessary to protect and buffer the premises for which such fences are intended or <br />adjacent fences are intended for adjacent premises; and <br />b. Would not be deleterious to adjacent property nor to the general public health, safety, or <br />welfare; and <br />Would be consistent with the intent and purpose of the fence regulations as stated in <br />Section 4 -540 (1) of the Zoning Code. <br />8. The Planning Commission and City Council determined the findings of Section 4- 540(3)(F) <br />iv ere met given the following: <br />This proposed kennel area is already being used to exercise dogs. <br />The kennel will be appropriately screened with fence slats and landscaping. <br />The applicant has stated the kennel will be cleaned daily. <br />No animals will be left unsupervised, ensuring incessant barking shouldn't be <br />problematic. <br />Kenneling the animals provides for a more orderly and safe environment for the public. <br />Allowing construction of a kennel utilizing an 8' fence, rather than a 6' fence, allows the <br />applicant to continue to make reasonable use of their property as a veterinary clinic. <br />Now REFORE BE IT RESOLVED, that based upon the above findings of fact the application for <br />a Si fe an (LP2013 -004) and Special Use Permit (SP2013 -003) are hereby approved, subject to <br />the wing conditions: <br />1. proposed kennel meets the 30' side street yard (west side) building setback. <br />2. proposed k ennel shall be limited to a maximum 10' x 34' footprint, and be constructed <br />black, vinyl chain link, with fence slats on the east, west, and south sides. <br />3. e proposed ornamental grasses and shrubbery depicted on the Landscape Plan shall be <br />i i iplemented to ensure the kennel is appropriately screened. <br />4. animals shall be left in the kennel unsupervised and the kennel shall be cleaned daily. <br />Ado ted this 28th day of May, 2013. <br />A : r <br />Dave JOAsen, Mayor <br />Danis A.
