ARTICLE 2. <br /> 2.01 Term. The term of this Agreement shall begin on the Commencement Date <br /> and shall expire on the Expiration Date. Beginning on the Commencement Date, Lessor <br /> shall deliver possession of the Premises to Lessee, together with non-exclusive right for <br /> ingress and egress to the Premises, seven (7) days a week, twenty-four (24) hours a <br /> day, and for the installation and maintenance of utility wires, cables, conduits, and pipes <br /> over, under, or along a twenty-foot wide right-of-way and easement extending from the <br /> nearest public right-of-way (5 1' Street SW) to the Premises, at a location to be approved <br /> by the Lessor's City Engineer. <br /> Lessor agrees to execute without delay any easement documents covering the <br /> then current lease term as may be required by any utility company in connection with <br /> Lessee's use of the Premises. <br /> 2.02 Rent. This Agreement shall be for an initial term of five (5) years, <br /> commencing on the Commencement Date, at an annual rental of Twenty Eight <br /> Thousand and no/100 Dollars ($28,000.00), increased annually by an amount equal to <br /> four percent (4%). All Rent shall be paid annually in advance on the Commencement <br /> Date for the initial year and thereafter on the first day of January. The Rent for the <br /> initial and final partial years shall be prorated. The initial Rent payment will be <br /> forwarded by Lessee to Lessor within forty-five (45) days after the Commencement <br /> Date. <br /> The Rent shall be increased on January first of each year by an amount equal to <br /> four percent (4%). <br /> Such Rent shall be paid to the City of New Brighton or to such other person, firm, <br /> or place as the Lessor may, from time to time, designate in writing at least thirty (30) <br /> days in advance of any rental payment date. <br /> 2.03 Right to Extend. Lessee shall have the right to extend this Agreement for <br /> three (3) additional five (5) year Renewal Terms, and the Agreement will automatically <br /> extend for each successive Renewal Term unless Lessee gives Lessor written notice of <br /> its intention to terminate at least ninety (90) days before the expiration date of the term. <br /> 2.04 Renewal Rental. The Rent during each Renewal Term will increase <br /> annually in accordance with Section 2.02, above. <br /> 2.05 Lessee's Use. Lessee shall use the Premises for the purpose of <br /> constructing, maintaining, and operating a radio communications facility and uses <br /> incidental thereto (the "Facility"), consisting of one (1) building not to exceed 240 square <br /> feet (12' x 20'); up to nine (9) directional panel antennas; and all necessary connecting <br /> 3 <br />
