26.11 Data Privacy <br /> Test result reports and other data acquired by the City in the drug or alcohol-testing <br /> process is private data on individuals in pursuant to Chapter 13 of the Minnesota <br /> Statutes. The City will disclose the information internally only to management and <br /> confidential employees with a need to know and to the tested individual. The <br /> information will not be released to any third party without the written consent of the <br /> tested individual except under the following circumstances: <br /> • The data may be used in an arbitration proceeding pursuant to a collective <br /> bargaining agreement, an administration hearing under Chapter 43A or other <br /> applicable state or local law, or a judicial proceeding, provided that the <br /> information is relevant to the hearing or proceeding. <br /> • The information may be disclosed to a federal agency or other unity of the United <br /> States government as required by federal law, regulation, order, or contract. <br /> • The information may be disclosed to a substance abuse treatment facility for the <br /> purpose of evaluation or treatment of the employee. <br /> Positive test results from the City's drug or alcohol testing program may not be used as <br /> evidence in a criminal action against the employee or job applicant. <br />
