Nonconforming Use Permit Standards Worksheet
1.) The total number of nonconformities is reduced.
This is not maintained because the addition will maintain the existing setback. It will not
increase it. Adding the deck would change the setbacks on the North side if we are
approved for the 10ft deck.
2.)The impact of any nonconformity upon adjustment premises is reduced to the
greatest practical extent.
Other homes in the neighborhood seem to have been grandfathered into the same
setbacks as my house. My house is already at the 5-6 ft setback and the addition will
not further impact my neighbors. Adding the deck will not impact neighbors because the
closest neighbor on the North side is a full city lot away.
3.)The extent of any nonconformity is reduced where practical.
It is not practical to meet the current setbacks of 30ft. The topography of the land is not
level and the North side of the lot is higher. Also in order to meet current setbacks the
layout of the home will create flow issues. Adding a deck the is 7 ft wide will not allow for
a picnic table or table and chairs, if we were to expand it to 10 ft this would give enough
room to have either.
