RESOLUTION <br /> PLANNING COMMISSION <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL OF A SITE PLAN. <br /> WHEREAS,an application has been made by Andrew Wahl on behalf of Dental Properties, LLC for <br /> consideration of a Site Plan in order to construct a 3,365 SF addition to the dental office clinic <br /> currently under construction at 850 County Road D West, <br /> WHEREAS,the procedural history of the application is as follows: <br /> 1. An application for a Site Plan Review was received on August 2, 2013. <br /> 2. The Site Plan was deemed complete upon submittal. <br /> 3. The Planning Commission reviewed the request on August 20, 2013. <br /> 4. The Planning Commission recommended approval of the Site Plan application. <br /> WHEREAS,the Planning Commission makes the following Findings of Fact with respect to the Site <br /> Plan(LP2013-005): <br /> 1. Resolution 13-012 was adopted by the City Council on January 22, 2013 outlining the <br /> parameters under which the property at 850 County Road D West is to be developed. <br /> 2. The property is zoned B-3, General Business. <br /> 3. The property is guided in the Comprehensive Plan for Community Business. <br /> 4. The existing property area is 1.5 acres or 66,070 SF. <br /> 5. The proposed use of the addition as a dental specialty clinic is a permitted use in the B-3, <br /> General Business zoning district. <br /> 6. The proposed Site Plan consists of constructing a 3,365 SF addition to the existing dental <br /> clinic and associated landscaping improvements. <br /> 7. The original Site Plan approved per Resolution 13-012 was designed to accommodate a <br /> future expansion, thus not necessitating the need to build additional parking. <br /> 8. The Planning Commission reviewed the Site Plan in accordance with Zoning Code Chapter <br /> 5, Sections 6-390, 8-010, and Chapter 11. <br /> 9. The Planning Commission also considered a parking "special circumstance" per Zoning <br /> Code Section 11-040(4) to allow construction of 48 parking stalls when 49 would normally <br /> be required when enforcing a one stall per 200 SF office space ratio. <br /> 10. The applicant provided evidence in support of this special circumstance within the written <br /> narrative attached to the Planning Report dated 8/14/2013. The Planning Commission <br /> determined the information was adequate in support of allowing 48 parking stalls vs. 49. <br /> 11. The Planning Commission reviewed the proposed use, building setbacks, parking setbacks, <br /> required # of parking stalls, floor area ratios, building height, performance standards, <br /> landscaping, lighting, signs, and interdepartmental concerns and found the proposed <br /> development to fully comply with all Site Plan requirements of the Zoning Code, subject to <br /> four conditions. <br /> I:\COMMISSIONS\PLANNING\Reports\2013\8-20-2013\LP2013-005(Dental Properties LLC)-RESOLUTION.doc 1 <br />
