This criterion is partially met. While the nonconformities are not being reduced, practically
they cannot be without removing the entire home.
3) The extent of any nonconformity is reduced where practical.
This criterion is met. It is not practical to reduce and/or eliminate the nonconformities as
that would require total removal of both the detached garage and home.
The applicant provided responses to these criteria on the attached Nonconforming Use Permit
Standards Worksheet. Based on the above analysis, staff finds the nonconforming use criteria to
be met. This is primarily because it would not be practical to require total removal of all the
structures on a lot in order to allow an expansion.
STAFF RECOMMENDATION
Staff recommends approval of the Variance and Nonconforming Use Permit as requested,
subject to the following:
1) The addition is built generally in accordance with the submitted plans attached to the
Planning Report dated 8/15/2013.
2) The addition is constructed of like colors and materials of the existing home and roof
lines are proportional to the existing roof.
614flii Gluata 0--
Janice Gundlach, City Planner
