MINUTES - CLOSED SESSION <br /> New Brighton Economic Development Commission Not Approved <br /> Regular Meeting—March 19, 2013 <br /> Members/Liaisons Present: Chairperson Paul Zisla, Commissioners Mike Murlowski, <br /> Al Potter,Linda Zelm, Marie Carrell, D.L. Beach, and Councilmember Mary Burg <br /> Members/Liaisons Absent: Commissioners Vivian Neumann-Walker and Bruce Knight <br /> Staff Present: Grant Fernelius-Community Development Director, Dean Lotter-City <br /> Manager, Katie Bruno-Office Assistant. <br /> Also Present: Scott Landsman, Hoff, Barry& Kozar, P.A. <br /> Update on Pulte Homes discussions <br /> At 8:12 am Scott Landsman stated that the Commission will enter Closed Session <br /> pursuant to Minnesota Statute 13D.05, Subdivision C3 to discuss the offer and <br /> counter-offer of the sale city owned property identified as Block I-New Brighton <br /> Exchange. <br /> Motion by Commissioner Zelm, seconded by Commissioner Potter to enter into <br /> closed session at 8:13 am. <br /> 6 Ayes-0 Nays, Motion carried <br /> Mr. Landsman reminded the Council that the discussion during the closed session is <br /> limited to the offer and counter-offer specifically to this project. Also it was noted that <br /> the meeting is being recorded, and the audio will be available once negotiations are <br /> complete. <br /> Director Fernelius reported that Pulte's offer is at $1,300,000. The appraisal came in <br /> between $1,100,000 and $1,200,000. The appraiser looks at comparable raw land <br /> transactions, and commented that there are extraordinary costs associated with clean up <br /> and the transporting of additional soil to the site. The estimates for these extraordinary <br /> costs were $500,000 to $675,000; resulting in a clean land price between $1,500,000 and <br /> $2,000,000. Fernelius reported that the most recent offer included Pulte paying <br /> $2,300,000, holding $1,000,000 in escrow to cover clean-up costs. <br /> Commissioner Beach asked if top-soil grading for residential lots is included. Fernelius <br /> responded those are details that would be negotiated at a later date, noting that the <br /> developer is seeking to me meet MPCA's residential clean-up standards. It was noted <br /> that the amount of fill required is not clear yet, and part of the issue with cost will be <br /> dependant upon the amount required.
