DEPARTMENT HEAD'S APPROVAL: ( -+ CITY MANAGER'S APPROVAL: No comments to supplement this report Comments attached Recommendation: To approve Change Order 1 in the amount of$27,272.57 and Partial Payment 2 for City Project 13-1, 2013 Street Rehabilitation to Northwest Asphalt,Inc. in the amount of$230,576.68. Legislative History: Neighborhood Informational Meeting February 13, 2013 Council received Feasibility Study March 12,2013 Council set date for Public Hearing March 12,2013 Improvement Hearing (approved project) April 9, 2013 Council approved Plans and Specifications May 28, 2013 Bids opened by Staff July 2, 2013 Bid Awarded July 9,2013 Financial Impact: The attached change order includes extra crew time on Windsor Way and Windsor Court to address an "excess of underground utilities" the Contractor encountered that were not shown on the plans. The contractor had to take extra care in the relocation and installation of storm sewer, sanitary sewer, watermain and proposed structures or services to cross existing gas, fiber optic, electrical and telephone/cable lines. Staff and the contractor are in the process of negotiating all change orders as a result of excess utilities. It is anticipated that future change orders of the same magnitude of this one will be coming for work on Windsor Lane. This change order also includes the replacement of an existing bituminous trail that was used to access and install the stormwater pond outlet structure. As part of the trail replacement, the contractor will also install a new storm sewer catch basin and pipe to collect localized drainage and direct it to the pond. This work was not anticipated at the time of the bid and would need to be paid for by change order. Please see attached payment breakdown for details. Explanation: The project consists of the removal and replacement of the bituminous surfacing, the removal and replacement of designated sections of concrete curb and gutter, sidewalk improvements, storm sewer improvements, sanitary sewer repairs,and watermain replacement on the following streets: Windsor Lane - Entire Loop(Silver Lake Road) Windsor Court - County Road E to Cul-de-sac Windsor Way - Windsor Court to 20th Ave SW Costs and Funding: This project will be funded from a combination of City of New Brighton general taxes, Municipal State Aid funds, special assessments, and utility enterprise funds. The provisions of the contract with Northwest Asphalt, Inc. stipulate that the City makes a partial payment to the contractor at least once each month at regular intervals on the basis of the work performed during that preceding month.
