RESOLUTION 110. <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEw BRIGHTON <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A SPECIAL USE PERMIT. <br />WHEREAS, an application has been made by Chris Wolla on behalf of the New Brighton Parks and <br />Recreation Department requesting a special use permit to allow construction of a 30' x 40' <br />maintenance garage at 1975 Silver Lake Road, Brightwood Hills Golf Course, and <br />WHEREAS, the procedural history of the application is as follows: <br />1. An application for a Special Use Permit was received on January 31, 2014. <br />2. A public hearing notice was published in the New Brighton Sun Focus on February 7, 2014. <br />3. Public hearing notices were mailed to property owners within 350' of the golf course <br />property on February 7, 2014. <br />4. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on February 18, 2014 where all interested parties were heard. <br />5. The Planning Commission recommended approval on February 18, 2014. <br />6. The City Council considered the request on February 25, 2014 <br />WHEREAS, the Planning Commission and City Council make the following Findings of Fact with <br />respect to the Special Use Permit (SP2014 -001): <br />1. The property is zoned R -1, Single Family Residential. <br />2. The property is guided in the Comprehensive Plan for P, Park. <br />3. The property address is 1975 Silver Lake Road. <br />4. The current use of the property is a municipal golf course. <br />5. New Brighton Parks and Recreation staff has requested a special use permit to allow <br />replacement of two existing storage buildings with one, 30' x 40' maintenance garage, which <br />will be used for general storage of equipment and materials needed to maintain the golf <br />course. <br />6. The proposal consists of a steel building placed upon a concrete pad, painted in colors to <br />compliment /match the existing clubhouse. <br />7. The Planning Commission and City Council reviewed the proposal in accordance with the <br />following Special Use Permit conditions of Zoning Code Section 8 -130: <br />a. That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort or general welfare. <br />b. That the special use will not be injurious to the use and enjoyment of other property in <br />the immediate vicinity for the purposes already permitted, nor substantially diminish and <br />impair property values within the neighborhood. <br />c. That the establishment of the special use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in the <br />district. <br />d.
