RESOLUTION NO. <br />14 -018 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />MAKING FINDINGS OF FACT AND APPROVING A SITE PLAN AND NONCONFORMING USE <br />;, an application has been made by Jim Demetriou on behalf of Emerald Manor <br />nts to consider a Site Plan and Nonconforming Use Permit to allow construction of 20 <br />al surface parking stalls at 1380 & 1390 7t" ST NW, and <br />RE AS. the procedural history of the application is as follows: <br />Ai� application for a Site Plan and Nonconforming Use Permit were received on January 14, <br />2 4. <br />2. A ublic hearing notice was published in the New Brighton Sun Focus on February 7, 2014. <br />3. Public hearing notices were mailed to property owners within 350' of the golf course <br />pr c pen y on February 7, 2014. <br />4. T Planning Commission, pursuant to published and mailed notices, held a public hearing <br />or February 18, 2014 where all interested parties were heard. <br />5. Tlic Planning Commission recommended approval on February 18, 2014. <br />6. At City Council considered the request on February 25, 2014. <br />WHERI S, the Planning Commission and City Council make the following Findings of Fact with <br />respect to the proposed Site Plan (LP2014 -001) and Nonconforming Use Permit (NC2014 -001): <br />1. The property is located at 1380 & 1390 7" ST NW. <br />2. property is zoned R -3A, High Density Residential. <br />3. T . property is guided in the Comprehensive Plan for HDR, High Density Residential. <br />4. TI total property area is approximately 1.73 acres. <br />5. Thl applicant proposes to construct 20 additional surface parking stalls between the existing <br />mo buildings. The proposed project includes removal of the concrete pad /barbeque area, <br />fence, and small shed to made room for the additional parking stalls. <br />6. The Planning Commission and City Council reviewed Site Plan in accordance with Zoning <br />Cc le Section 8 -010, and found all applicable criteria to be met. <br />7. T1 } Planning Commission and City Council considered the parking setback standards of <br />Section 11- 020(6) and the off - street parking stall requirements of Section 11 -030. <br />8. SeNeral nonconformities were examined as outlined in the written Planning Report dated 2- <br />13 014. <br />9. T1. d Planning Commission and City Council reviewed the Nonconforming Use Permit <br />cr ria in accordance with Zoning Code Section 8 -460, <br />10.
