He thought the community center was a major community asset and something <br />ofwhich the City should be proud <br />Councilmember Bauman asked if motionless fixtures would be pursued. Assistant Parks and Recreation <br />Director Hicks stated this was the case. <br />Mayor Jacobsen supported the project and understood the reshnoms/locker rooms were in need of restoration. <br />He wanted to be assured that the improvements met both the Council and the users' expectations. He wanted <br />to see that the project proceeded with durable materials that would last. <br />Councilmember Jacobsen thanked staff for being forward thinking on this project He was pleased with the <br />proposed project, noting it would address the seating concerns as well. He encouraged the Council to <br />property maintain the restroom facilities in order to keep the current members that it has. Resolution Authorizing Execution of a Restated and Amended Contract for Private <br />Redevelopment by and between the City of New Brighton and Pulte Homes of Minnesota, <br />LLC for the sale and redevelopment of land in New Brighton Exchange. <br />Report No. 14 -076. Resolution No. 14 -025. <br />City Manager Lotter explained Community Development Director Fernelius would be <br />presenting this item to Council. <br />Community Development Director Femehus stated Pulte Homes has been working with the City since April <br />2012 on the redevelopment of a 26 -acre tract of land referred to as the Enclave at New Brighton Exchange. <br />The project includes the construction of 89 single - family homes and 34 townhomes. In June 2013, the <br />company entered into a Contract for Private Redevelopment with the City. This agreement spelled out a due <br />diligence period (October 31, 2013) and a closing date for no later than December 31, 2013. However, the <br />MPCA took longer than normal and requested additional information from the company on their <br />development and cleanup plans. Without these approvals being completed in a timely manner, Pulte had no <br />other choice but to terminate the agreement. The company remains committed to the project and has been <br />working with their consultant to obtain the MPCA approvals. In late Febnzary, the City and Pulte <br />participated in a meeting with the MPCA and learned that the agency would approve the development <br />project, subject to several conditions. Among the conditions is that Pulte ensure at least 12' of clean cover is <br />placed beneath future homes; and that a plan be developed for venting systems and air sampling. Pulte is <br />working with their consultant on an amended Response Action Plan (RAP). He indicated that Pulte was <br />requesting to reinstate the redevelopment agreement that was terminated last year Due to the delayed <br />schedule, Pulte is proposing to modify a few key dates. He reviewed the date changes with the Council, <br />noting all other business terms and conditions would remain unchanged Staffrecommended the Council <br />approve a Resolution authorizing execution of a restated and amended contract for private redevelopment by <br />and between the City and Pulte Homes for the sale and redevelopment of land in New Bright Exchange. <br />David Debach, Pulte Homes, thanked the Council for reconsidering the amended contract for the Enclave. <br />He discussed the staffing changes at Pulte Homes and reported he would be working with the City on this <br />project He reported he was satisfied with the MPCA noting this organization has been slower to respond <br />than was originally anticipated He commented a closing date was anticipated by June and construction <br />would commence shortly thereafter. <br />Mayor Jacobsen questioned if the MPCA requirements would change the style of homes that could be built at <br />the Enclave.
