RESOLUTION NO.0 41 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />MAKING FINDINGS OF FACT AND APPROVING A SPECIAL USE PERMIT. <br />ks, an application has been made by Evan Staples on behalf of Honest -1 Auto Care <br />ling a special use permit to allow operation of a automotive services use out of the existing <br />tenant space at 2166/2176 Silver Lake Road, known as the Rice Creek Shopping Center. <br />WHERNAS, the procedural history of the application is as follows: <br />1. application for a Special Use Permit was received on May 2, 2014. <br />2. ublic hearing notice was published in the New Brighton area Sun Focus on May 9, 2014. <br />3. P lic hearing notices were mailed to property owners within 350' of the applicant's <br />p perty on May 7, 2014. <br />4. T., c Planning Commission, pursuant to published and mailed notices, held a public hearing <br />o May 20, 2014 where all interested parties were heard. <br />5. T, e Planning Commission recommended approval to the City Council on May 20, 2014, <br />si] ject to conditions. <br />WHEREAS, the Planning Commission and City Council make the following Findings of Fact with <br />respe to the Special Use Permit (SP2014 -003): <br />L T, e property is zoned B — 3, General Business. <br />2. T e property is guided in the Comprehensive Plan for CB, Community Business. <br />3. T e property address is 2166/2176 Silver Lake Road, an existing tenant space at the north <br />eno of Rice Creek Shopping Center formerly known as the Lowell Auto Parts store. <br />4. T 'e applicant is proposing to operate a 5,500 SF automotive repair services use (not <br />ir luding body work), consisting of seven service bays facing Mississippi Street and a <br />Ic by /waiting area storefront facing Silver Lake Road. <br />5. T proposal includes renovations to the existing eastern and northern building fagades, but <br />no other exterior improvements /changes. <br />6. h. accordance with Zoning Code Section 5- 240(7) a special use permit is required for <br />automotive service uses. <br />7. Tt Planning Commission and City Council reviewed the proposal in accordance with the <br />fallo ",ing Special Use Permit conditions of Zoning Code Section 8 -130: <br />a That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort or general welfare. <br />b. That the special use will not be injurious to the use and enjoyment of other property in <br />the immediate vicinity for the purposes already permitted, nor substantially diminish and <br />impair property values within the neighborhood. <br />c.
