He stated the fountain would provide a visual impact while also <br />assisting in the elimination of the algae. <br />City Attorney LeFevere commented the City notice could inform residents surrounding this <br />pond that the City was exploring several options for the treatment of the pond. He <br />recommended the Council make a motion directing staff to prepare notice with Option 3 and set a <br />hearing on the improvement noting there would be a range of options for the pond treatment with the City <br />making a contribution of 25% to 35 %. <br />Councilmember Jacobsen withdrew his motion. <br />Motion by Councilmember Jacobsen, seconded by Councilmember Burg to recommend Option 3, <br />for future consideration of a new Innsbruck Pond Taxation District, including single family and <br />townhome properties that back up to Innsbruck Park combined, directing staff to create scenarios <br />with various costs for the potential maximum assessment under the creation of the taxation district. <br />5 Ayes, 0 Nays -Motion Carried <br />5. Consideration of awarding bid for City Project 14 -2C Mill and Overlay. Report <br />No. 14 -135. <br />City Manager Lotter explained Public Works Director Wyffels would be presenting this item to Council. <br />Senior Engineering Supervisor Schlichting reported the Council approved the plans and <br />specifications for City Project 14 -2C and 14 -3 in April and bids were opened on May 20th. The <br />project area was reviewed in detail with the Council. He explained that the City received bids <br />from eight vendors with the low bid from Park Construction Company in the amount of <br />$244,937.58, which is 14.4% below the engineer's estimate. Staff recommended the Council <br />accept all bids except North Valley, Inc. as it was not valid and award a contract to Park <br />Construction Company, while also authorizing staff to negotiate a change order for the addition <br />of Oakwood Drive and Innsbruck Court and request staff solicit quotes to stripe and /or paint <br />basketball courts as recommended by PREC. The painting options for the basketball court was <br />discussed in detail with the Council. <br />Councilmember Jacobsen questioned if he had to abstain from voting on this matter due to the <br />fact he lived within the street improvement project area. City Attorney LeFevere commented <br />this was not the case as Councilmember Jacobsen would not gain financially from the roadway <br />improvement. <br />Motion by Councilmember Bauman, seconded by Councilmember Bug to accept all bids except <br />North Valley, Inc. since it was not valid and adopt a Resolution awarding a contract for City Project <br />14-2C, Mill and Overlay and 14-3,2014 Pavement Management Plan to the lowest responsible bidder, <br />Park Construction Company, in the amount of $244,93758. <br />5 Ayes, 0 Nays -Motion Carried <br />Motion by Councilmember Burg, seconded by Councilmember Jacobsen to authorize staff to <br />negotiate a change order for the addition of the following streets into City Project 14-2C, Mill and <br />Overlay: <br />• Oakwood Drive From 7th Street NW to 10th Street NW <br />• Innsbruck Court From Innsbruck Drive to Cul -de -sac <br />5 Ayes, 0 Nays -Motion Carried <br />5.
