She stated <br />she was amazed by the carp population in Long Lake. Ryan discussed how the RCWD would <br />be addressing the carp population in Long Lake. <br />Motion by Councilmember Jacobsen, seconded by Councihnember Burg to adopt a Resolution that <br />would authorize and accept the Rice Creek Watershed to amend the petition for the New Brighton/St. <br />Anthony Basic Water Management Project, Rice Creek Watershed District Project 2013 -01. <br />5 Ayes, 0 Nays -Motion Carried <br />3. Consideration of a Special Use Permit to allow construction and implementation of a revised <br />sound mitigation berm and plan at 2200 Old Highway 8 NW, known as Belair Excavating. <br />Report No. 14-133. <br />City Manager Lotter explained Planning Coordinator Gundlach would be presenting this item to Council. <br />Planning Coordinator Gundlach stated the applicant is requesting a Special Use Permit to allow <br />implementation of a new sound mitigation plan for the property located at 2200 Old Highway <br />8 NW, known as Belair Excavating. The sound mitigation plan relates to previous land use <br />approvals from 2010 that permitted the aggregate crushing /recycling and yard waste transfer <br />uses per Resolutions 10 -068 and 10 -069. Those previous approvals required construction of a <br />sound mitigation berm north -south along the western property boundary to mitigate onsite <br />noise from spilling over into residential areas to the west. The previously approved berm was <br />to achieve a peak elevation of 926. The previous approval allowed the applicant to take 3 <br />years to construct the berm but unfortunately, due to issues regarding overhead power lines <br />easements, the berm cannot be constructed as proposed and the applicant has abandoned that <br />plan in favor of a new plan they believe achieves the same sound mitigation results. <br />The original berm approved in 2010 will remain as approved and constructed, with the <br />exception of the 130' gap under the transmission line easement area. The revised sound <br />mitigation plan proposes the following additional 3 elements: <br />1. Construct a new sound barrier directly east of the electrical transmission tower to an <br />elevation of 940 (14' higher than the existing sound berm, with a total height of 40'). <br />The barrier will run north/south continuously a span of 345' -375' in length. This plan <br />is illustrated on a Site Plan attached to the Wenck sound report. Conceptual cross - <br />sections views of the proposed berm have been provided to staff. <br />2. Move the rubble dump area approximately 700' to the east (and 700' further away from <br />the residential uses). This results in the processed or crushed material, to be swapped <br />with the rubble pile location. <br />3. Limit the dump platform for gated trucks in the new rubble dump location to an <br />elevation not to exceed 25'. The applicant intends to bi -sect the rubble dump area into <br />two halves with non -gated trucks dumping on the north half at an elevation not to <br />exceed 40' and the gated trucks dumping on the south half at an elevation not to exceed <br />25'. <br />The northern 230' of the proposed sound berm/barrier would be constructed of compacted <br />rubble. The remaining section of sound barrier, or the southern 130', would be constructed as <br />partially compacted soil at the base (bottom 15' -19') and a manufactured concrete sound <br />barrier (wall) for the top 18' -22'. This berm/barrier construction achieves several goals <br />including: 1) adequately protects the transmission tower, 2) conserves yard space, and 3) <br />allows protection of an existing drainage swales and run -off filtering system.
