Not Approved <br /> PLANNING COMMISSION PROCEEDINGS <br /> Regular Meeting—May 20,2014 7:00 p.m. <br /> Present: Chairperson Bruce Howard, Commissioners Paul Banker, Steve Danger,Marvin Deick, Susan Erickson, and <br /> Verne McPherson <br /> Absent: Commissioner Erin Nichols-Matkaiti <br /> Also Present: Janice Gundlach-Planning Coordinator, and Gina Bauman-Councilmember <br /> Agenda Review: There were no changes to the agenda. <br /> Minutes from April 15,2014: <br /> Motion by Commissioner Banker,seconded by Commissioner Erickson,to approve the April 15,2014 meeting <br /> minutes as presented. <br /> Approved 6-0. <br /> Council Action: Councilmember Bauman reported the Council was considering an energy study from Johnson Controls. <br /> She provided an update from the Cable Commission regarding the Comcast franchise renewal. It was noted PEG fees was <br /> the biggest area of contention at this time. She reported the City would have to take action on the franchise agreement by <br /> June 20th <br /> Public Hearing: <br /> (A) CANCELLED: Joseph Sullivan requests a Variance to allow construction of a 14' x 10' house addition to <br /> the western side of the existing home at 980 7th Street NW, at a setback of 26' when 30' is normally <br /> required—Request WITHDRAWN <br /> Planning Coordinator Janice Gundlach reported the Variance request from the applicant,Joseph Sullivan has been <br /> withdrawn. <br /> (B) CONTINUATION: Murlowski Properties, Inc. requests a Special Use Permit to allow construction and <br /> implementation of a revised sound mitigation berm and plan on their property located at 2200 Old <br /> Highway 8 NW, known as Belair Excavating. <br /> Planner Janice Gundlach reported the applicant is requesting a Special Use Permit to allow implementation of a new <br /> sound mitigation plan for the property located at 2200 Old Highway 8 NW, known as Belair Excavating. The sound <br /> mitigation plan relates to previous land use approvals from 2010 that permitted the aggregate crushing/recycling and yard <br /> waste transfer uses per Resolutions 10-068 and 10-069. Those previous approvals required construction of a sound <br /> mitigation berm north-south along the western property boundary to mitigate onsite noise from spilling over into <br /> residential areas to the west. The previously approved berm was to achieve a peak elevation of 926. The previous <br /> approval allowed the applicant to take 3 years to construct the berm but unfortunately, due to issues regarding overhead <br /> power lines easements,the berm cannot be constructed as proposed and the applicant has abandoned that plan in favor of <br /> a new plan they believe achieves the same sound mitigation results. <br /> The original berm approved in 2010 will remain as approved and constructed, with the exception of the 130' gap under <br /> the transmission line easement area. The revised sound mitigation plan proposes the following additional 3 elements: <br /> 1. Construct a new sound barrier directly east of the electrical transmission tower to an elevation of 940(14' higher <br /> than the existing sound berm,with a total height of 40'). The barrier will run north/south continuously a span of <br /> 1 <br />
