ATTACHMENTS
A—Rezoning Ordinance
B —Resolution
C—Project Location Map
D—Aerial Photo (year 2012)
E—Current Zoning Map
F—Proposed Zoning Map
G—Future Land Use Map
H—Proposed Future Land Use Map
I—Neighborhood Notification Map
J—Ordinance No. 820 (moratorium)
FINDINGS
Chapter 8, Article 3. Rezoning
SITE CHARACTERISTICS
Location: Northeast Corner of City
Parcel ID's 173023420006, 173023420007, 173023430002
Lot Size: Approximately 25 acres
Topography: Varies
Comprehensive Plan Designation: OSP, Open Space Preservation
Zoning: None
Surrounding Land Uses:
North: Belair Excavating
South: Rush Lake, Long Lake Regional Park
East: Industrial uses, Old Highway 8 NW
West: Rice Creek, Long Lake Regional Park
REZONING
The rezoning request consists of zoning the property depicted on the attached maps from right-
of-way (un-zoned) to I — 1, Light Industrial and R — 1, Single Family Residential. Staff finds
zoning the properties to I— 1 and R— 1 best matches the uses of surrounding properties, existing
land uses, provides MPI reasonable use of the property they purchased, and protects the general
public from other undesirable and/or inappropriate uses.
The majority of the property MPI intends to use (PID #173023420006) and which MPI has
provided proof of ownership of, is proposed to be zoned to I— 1, Light Industrial. There are two
other parcels denoted as railroad right-of-way immediately south (PID #173023430002) and
southeast (PID #173023420007) of the parcel MPI acquired. While MPI doesn't own these
parcels, and thus cannot utilize them for their expansion efforts, staff finds it appropriate to apply
a zoning at this time and that zoning should be consistent with surrounding properties and
existing underlying land uses. As such, staff has proposed R— 1, Single Family Residential for
these parcels (see Proposed Zoning Map).
Article 3 of Chapter 8 of the Zoning Code outlines the process to rezone property within the City
of New Brighton. The ordinance requires a public hearing before the Planning Commission,
preceded by published and mailed notice to property owner's within 350' of the proposed
property to be rezoned. Such notices shall be published and mailed within 10 days of the hearing
