completed by APi within the time frame set forth for Minimum Improvements in Section <br />5.4 of the Redevelopment Agreement. <br />3. DEVELOPMENT PLANS. The City hereby approves construction on the Subject <br />Property consistent with this Agreement and the exhibits included with the planning <br />report for the City Resolutions and any revisions to these exhibits as submitted and <br />approved by the City at the time of the issuance of the Building Permit (the "Site Plan "). <br />APi shall develop the Subject Property in accordance with the Site Plan. If, however, the <br />Site Plan varies from the written terms of this Agreement, the written terms shall control. <br />The exhibits to the staff report to the City Resolutions that are the Site Plan consist of the <br />following: <br />Exhibit A: Sheet C -102: Site Plan dated 06/27/14 <br />Exhibit B: Sheet C -103: Grading Plan dated 06/27/14 <br />Exhibit C: Sheet C -104: Utility Plan dated 06/27/14 <br />Exhibit D: Sheet C -105 thru C107: SWPPP & Erosion Control Plan dated 06/27/14 <br />Exhibit E: Sheet C -501 thru C -502: Details dated 06/27/14 <br />Exhibit F: Sheet L1: Landscape Plan dated 06/27/14 <br />Exhibit G: Sheet E1: Site Lighting Photometric Plan dated 06/27/14 <br />All of these Exhibits are made a part of this Agreement and are on file with the City <br />Engineer and City Planner. <br />4. IMPROVEMENTS. Unless otherwise noted, APi shall install and pay for the following: <br />A. Private Utilities as required by the Redevelopment Agreement. <br />B. Setting of Iron Monuments as required by local and state rules and regulations. <br />C. Landscaping on the Subject Property pursuant to Section 9 of this Agreement. <br />D. Landscaping and irrigation in adjacent public right -of -ways as shown on the Site <br />Plan. <br />E. Pedestrian improvements including but not limited to landscaping, irrigation, <br />concrete sidewalks, pedestrian ramps located in the adjacent public right of ways <br />as set forth in the Site Plan. City shall cost share $7,500 of the decorative pavers, <br />which shall be paid within 30 days after applicable improvements have been <br />completed to the satisfaction of the City. <br />F. The limestone pylons shown on the Site Plan will be installed and paid for by the <br />City. <br />G. Surveying and Staking needed for development of lots in the Subject Property. <br />H. Off -site Infiltration Basin Work on Outlot B pursuant to Section 10 of this <br />Agreement <br />APi shall obtain all necessary permits from the Minnesota Pollution Control Agency, <br />Minnesota Department of Health and other agencies before proceeding with construction <br />(except to the extent the City is required to obtain any such permits pursuant to the <br />Redevelopment Contract). <br />2 <br />
