completed by APi within the time frame set forth for Minimum Improvements in Section 5.4 of the Redevelopment Agreement. 3. DEVELOPMENT PLANS. The City hereby approves construction on the Subject Property consistent with this Agreement and the exhibits included with the planning report for the City Resolutions and any revisions to these exhibits as submitted and approved by the City at the time of the issuance of the Building Permit (the "Site Plan "). APi shall develop the Subject Property in accordance with the Site Plan. If, however, the Site Plan varies from the written terms of this Agreement, the written terms shall control. The exhibits to the staff report to the City Resolutions that are the Site Plan consist of the following: Exhibit A: Sheet C -102: Site Plan dated 06/27/14 Exhibit B: Sheet C -103: Grading Plan dated 06/27/14 Exhibit C: Sheet C -104: Utility Plan dated 06/27/14 Exhibit D: Sheet C -105 thru C107: SWPPP & Erosion Control Plan dated 06/27/14 Exhibit E: Sheet C -501 thru C -502: Details dated 06/27/14 Exhibit F: Sheet L1: Landscape Plan dated 06/27/14 Exhibit G: Sheet E1: Site Lighting Photometric Plan dated 06/27/14 All of these Exhibits are made a part of this Agreement and are on file with the City Engineer and City Planner. 4. IMPROVEMENTS. Unless otherwise noted, APi shall install and pay for the following: A. Private Utilities as required by the Redevelopment Agreement. B. Setting of Iron Monuments as required by local and state rules and regulations. C. Landscaping on the Subject Property pursuant to Section 9 of this Agreement. D. Landscaping and irrigation in adjacent public right -of -ways as shown on the Site Plan. E. Pedestrian improvements including but not limited to landscaping, irrigation, concrete sidewalks, pedestrian ramps located in the adjacent public right of ways as set forth in the Site Plan. City shall cost share $7,500 of the decorative pavers, which shall be paid within 30 days after applicable improvements have been completed to the satisfaction of the City. F. The limestone pylons shown on the Site Plan will be installed and paid for by the City. G. Surveying and Staking needed for development of lots in the Subject Property. H. Off -site Infiltration Basin Work on Outlot B pursuant to Section 10 of this Agreement APi shall obtain all necessary permits from the Minnesota Pollution Control Agency, Minnesota Department of Health and other agencies before proceeding with construction (except to the extent the City is required to obtain any such permits pursuant to the Redevelopment Contract). 2
