Iron monuments must be installed in accordance with Minn. Stat. Sec. 505.02. APi's <br />surveyor shall, within a reasonable time after said installation, submit a written notice to <br />the City certifying that the monuments have been installed. <br />5. LICENSE. APi hereby grants the City, its agents, employees, officers and contractors a <br />license to enter the Subject Property to perform all work and inspections deemed <br />appropriate by the City in conjunction with the development. <br />6. GRADING AND EROSION CONTROL. Prior to any construction activity on the <br />Subject Property, AN shall make application for a building permit, subject to the review <br />and approval of the City. The lots shall be final graded in accordance with the approved <br />Site Plan. Upon commencement of grading operations, the erosion control plan of the <br />Site Plan shall be implemented by APi and inspected and approved by the City. All areas <br />disturbed by the excavation and backfilling operations shall be reseeded forthwith after <br />the completion of the work in that area. Except as otherwise provided in the Site Plan, <br />seed shall be certified oat seed to provide a temporary ground cover as rapidly as <br />possible. All seeded areas shall be fertilized, mulched, and disc anchored as necessary <br />for seed retention. The parties recognize that time is of the essence in controlling <br />erosion. If APi does not comply with the Site Plan or supplementary instructions <br />received from the City and such non - compliance continues for a period of forty -eight <br />(48) hours following written notice from the City, the City may take such action as it <br />deems appropriate to control erosion. APi will reimburse all reasonable and necessary <br />expenses incurred by the City in connection with such actions. No development utility or <br />street construction will be allowed and no building permits will be issued unless the <br />Subject Property is in full compliance with the erosion control requirements. <br />Within thirty (30) days after completion of the grading of any lot, AN shall provide the <br />City with an "as constructed" grading plan and a certification by a registered land <br />surveyor or engineer that all final grading has been completed in accordance with <br />approved plans. The "as constructed" plan shall include field - verified elevations of the <br />following: a) location and elevations along all swales and ditches, b) finished floor <br />elevations, c) all catch basin or storm sewer casting elevations, d) retaining wall <br />elevations, d) any critical drainage feature, e) ties and elevations to all sewer and water <br />services and gate valves, and f) any other detail required by the City Engineer. The City <br />will withhold issuance of certificates of occupancy until the approved certified grading <br />plan is on file with the City and all erosion control measures are in place as determined <br />by the City Engineer. <br />7. CLEAN UP AND REPAIR. APi shall daily clean dirt and debris from streets or ponds <br />within the Subject Property that have resulted from construction work by APi, its agents <br />or assigns and shall restore to the City's specifications any damage to the public <br />improvements resulting from the use of construction equipment. Prior to any construction <br />on the Subject Property, APi shall identify in writing a responsible party for erosion <br />control, street cleaning and street sweeping. <br />8. CITY LEGAL. APi shall pay a fee to cover the City's legal expenses for legal services <br />for enforcement of this Agreement, pursuant to Section 13.13 below. <br />3 <br />
