TEMPORARY CONSTRUCTION EASEMENT <br />THIS EASEMENT AGREEMENT is made this day of , 2014, by <br />and between the City of New Brighton, a municipal corporation of the State of <br />Minnesota ( "Grantor ") and the Metropolitan Council, a public corporation and political <br />subdivision of the State of Minnesota ( "Grantee ") hereinafter collectively referred to as the <br />"Parties ". <br />NOW THEREFORE, for valuable consideration, the Parties agree as follows: <br />Grant of Easement. Grantor, the owner of the property described as: <br />Outlots A and B, New Brighton Exchange 2nd Addition, according to the plat thereof on file and <br />record in the office of the County Recorder in and for Ramsey County, Minnesota. <br />Outlots B and C, New Brighton Exchange lsc Addition, according to the plat thereof on file and <br />record in the office of the County Recorder in and for Ramsey County, Minnesota. <br />(herein referred to as the "Property "), in consideration of One Dollar and other good and <br />valuable consideration to it in hand paid, the receipt of which is hereby acknowledged, does <br />hereby grant, bargain, sell and convey to Grantee, its permittees, successors and assigns, the <br />following described temporary easement: <br />Temporary Construction Easement. <br />A temporary, non - exclusive construction easement over, under and across the Property, <br />shown on attached Exhibit A, for the rehabilitation of Grantee's existing sanitary sewer <br />pipe. The pipe will be repaired using trenchless technology (cured -in- place - pipe). <br />Construction access is needed for the purposes of installing, operating, and maintaining a <br />temporary conveyance system outside of the existing permanent easement and to gain <br />access to the Grantee's facilities. The temporary easement includes the right of entry to <br />perform any necessary restoration activities in the temporary easement areas. <br />449517v2 NE] 36 -24 <br />
