I <br /> Not Approved , <br /> • The access easement per Document No. 2460942 is released or revised to that access rights are fully <br /> within drive-aisles and not encroaching on parking islands or stalls. The language of a revised easement <br /> must be reviewed and accepted by the City Attorney. <br /> • The 16 proof-of-parking stalls must be built if the City determines the property is inadequately parked. <br /> Written notice will be given in the event the City requires construction of the 16 proof-of-parking stalls. <br /> • The wall sign illustrated on the proposed south elevation is not permitted in accordance with Chapter 9 of <br /> the Zoning Code. <br /> • Implementation of the requirements noted in the Interoffice Public Works/Engineering memo dated <br /> 6/13/2012, attached this report. <br /> Commissioner Danger questioned who would release the access easement to the applicant. Planner Gundlach <br /> explained the applicant would need this easement released from the property to the east. <br /> Eric Chalmers, applicant and owner of AccuStream, introduced himself to the Commission and noted the property <br /> to the east was not interested in releasing the easement. <br /> Planner Gundlach indicated the easement was a private matter between the two properties. She explained that she <br /> would have to speak with the City Attorney regarding this matter as the easement does obstruct two parking stalls. <br /> Commissioner Banker asked if the road access abutting the easement interfered with the road access. Planner <br /> Gundlach reviewed the location of the driveway, the easement and access points. She was not concerned with <br /> access to and from the site. <br /> Commissioner Danger questioned if there were any watershed or drainage issues with the site plan. Planner <br /> Gundlach noted the applicant had submitted his plans to the Rice Creek Watershed and was waiting for approval. <br /> She explained the City does not get involved in watershed issues but understood a rain garden may be needed on <br /> the site. <br /> Russ Rosso, architect for the applicant, stated the drainage drawings have been submitted to the Rice Creek <br /> Watershed and would be reviewed in the middle of July. He reviewed the property layout and discussed how the <br /> water would drain from this site. <br /> Commissioner Danger inquired if a rain garden was required by Rice Creek Watershed that eliminated several <br /> parking spaces, how the applicant would handle this matter. Mr. Rosso commented he was prepared to address <br /> this concern and that space was available. <br /> Chairperson Howard asked if another condition should be added to assure that all requirements from the Rice <br /> Creek Watershed are followed by the applicant. Planner Gundlach indicated this was covered in the Interoffice <br /> Public Works/Engineering memo dated 6/13/2012. <br /> Motion by Commissioner Shardlow,seconded by Commissioner Meyers to approve staff recommendation. <br /> Approved 7-0 <br /> Other Business: Commissioner Danger questioned if Staff addressed the temporary sign concerns with the City's <br /> businesses. Planner Gundlach stated staff has visited every business in the community with an illegal temporary <br /> sign and handouts were provided with zoning code information. Staff was not going to visit this issue again until <br /> the end of June. <br /> Adjournment: <br /> Motion by Commissioner Danger,seconded by Commissioner Nichols-Matkaiti adjourn the meeting. <br /> 7 Ayes, 0 Nays,Motion Carried <br /> Meeting adjourned at 7:30 PM <br /> 2 <br />
