PLANNING REPORT <br /> DATE: July 11, 2012 <br /> CASE: SP2012-003 <br /> SUBJECT: Amendment to a Special Use Permit for 1820 Old Highway 8 NW <br /> APPLICANT: Tom Van Pelt on behalf of Citizens State Bank <br /> REQUEST&BACKGROUND <br /> The applicant is requesting an amendment to the previously approved Special Use Permit for <br /> 1820 Old Highway 8 NW. The previously approved special use permit allowed construction of a <br /> mixed use building and a fourth floor when normally only three floors is allowed. The mixed <br /> use provision allowed office uses on the first thru third floors and two residential units on the <br /> fourth floor. The special use permit amendment would be to convert the fourth floor from a <br /> residential use to an office use. <br /> This property has never been occupied since its initial construction, which began in 2006. The <br /> property has also changed hands numerous times and been in foreclosure. The applicant applied <br /> for permits to finish the shell of the building and all exterior improvements in late 2010, which <br /> carried over into 2011. It is staffs understanding the intent of the shell finish was to attract a <br /> buyer. The applicant has been working with a broker, but no buyer has ever materialized. At <br /> one point in 2011, Volunteers of America had approached the City on a residential reentry <br /> facility. That proposal was not consistent with the Zoning Code and the applicant ultimately <br /> withdrew their request. With this request, the applicant hopes to make the building more <br /> attractive to an office user, which is likely the most reasonable use of the property as currently <br /> finished. <br /> This property has an extensive approval history dating back to 2005.
