RESOLUTION <br /> PLANNING COMMISSION <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL A SITE PLAN AND <br /> NONCONFORMING USE PERMIT. <br /> WHEREAS, an application has been made by Joseph Wolkerstorfer on behalf of Wolkerstorfer <br /> Company Inc. to permit construction of a 9,000 SF addition to the existing industrial building <br /> located at 348/350 lst Street SW, and, <br /> WHEREAS,the procedural history of the application is as follows: <br /> 1. Applications for a Site Plan and Nonconforming Use Permit were received on November 2, <br /> 2012. <br /> 2. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br /> on November 20, 201f2 and all present were given a chance to freely speak at the hearing. <br /> 3. The Planning Commission recommended conditional approval on November 20, 2012. <br /> WHEREAS,the Planning Commission makes the following Findings of Fact with respect to the Site <br /> Plan(LP2012-002) and Nonconforming Use Permit(NC2012-002): <br /> 1. The property is zoned I—2, Heavy Industrial. <br /> 2. The property is guided in the Comprehensive Plan for HI, Heavy Industrial. <br /> 3. The applicant is proposing to construct a 9,000 SF addition to the northeast side of the <br /> existing industrial building. <br /> 4. The applicant does not propose construction of any additional off-street parking, but rather <br /> proof-of-parking areas have been identified on the Site Plan. <br /> 5. The applicant states the number of existing off-street parking stalls will be adequate to meet <br /> additional employee demands resulting from the proposed addition. <br /> 6. The Planning Commission considered the Site Plan in accordance with I - 2 district standards <br /> of Section 6-150 (refers back to 6-060), the commercial performance standards of Section 6- <br /> 390, Site Plan standards of Section 8-010 and the parking standards of Chapter 11 of the <br /> Zoning Code. <br /> 7. The Planning Commission and City Council found all applicable Site Plan standards to be <br /> met as outlined in the Planning Report dated November 15, 2012. <br /> 8. The Planning Commission identified the following nonconformities on the property: <br /> a. Rear yard building setback less than 20' at 18'. <br /> b. Side yard parking setback(east side) less than 5' at 3.5'. <br /> c. Required number of off-street parking stalls is less than required at 64 when 170 are <br /> required for the existing building and an additional 23 stalls are required for the proposed <br /> addition. <br /> 9. The Planning Commission considered the Nonconforming Use Permit in accordance with <br /> Section 8-460 (2) and the following criteria: <br /> a. The total number of nonconformities is reduced. <br /> b. The impact of any nonconformity upon adjacent premises is reduced to the greatest <br /> practical extent. <br /> 1 <br />
