• The impact of any nonconformity upon adjacent premises is reduced to the greatest <br /> practical extent. <br /> • The extent of any nonconformity is reduced where practical. <br /> The existing nonconformities on the Wolkerstorfer site related to parking and building setbacks <br /> are not practical to reduce. Further, the extent of these nonconformities is so minor in that under <br /> both situations the nonconformities amounts to 2' or less. However, the applicant has essentially <br /> reduced, and nearly eliminated, the nonconformity related to off-street parking based on the <br /> proof of parking concepts provided. With that, staff finds these criteria are met and would <br /> recommend approval. However, it should be noted that if and when any of the proof of parking <br /> stalls are built, a Site Plan approval will be necessary to ensure all standards are met. <br /> STAFF RECOMMENDATION <br /> Approval of the Site Plan and Nonconforming Use Permit as submitted, subject to the following <br /> conditions: <br /> 1. The proposed improvements are built in accordance with the plans provided. <br /> 2. Implementation of the recommendations contained in the interoffice Engineering/Public <br /> Works and Public Safety memos. <br /> 3. The City reserves the right to request construction of additional proof of parking stalls at <br /> a future date in the event off-street parking becomes limited for users of the site. If <br /> necessary, the City will notify the property owner in writing as to whether or not <br /> additional off-street parking should be installed. <br /> 4. Construction of any of the proposed proof of parking stalls shall require a separate Site <br /> Plan approval. <br /> 5.
