Not Approved <br /> The applicant opted to wait until the July meeting to speak. <br /> Motion by Commissioner McPherson, seconded by Commissioner Danger to continue the Public Hearing <br /> until July 19, 2011. <br /> Approved 7-0 <br /> City Planner Gundlach noted the Public will be re-notified of the July 19th meeting. <br /> (B) Medtox Scientific, Inc. requests a Site Plan and Nonconforming Use Permit to allow a <br /> northerly expansion of the existing surface parking lot and other related parking lot <br /> improvements located at 354-450 County Road D West. <br /> City Planner Gundlach reported the applicant is requesting a Site Plan and Nonconforming Use Permit to <br /> allow a northerly expansion of the existing parking lot, adding a total of 75 parking stalls and a large <br /> infiltration basin. Also included in the request is a Nonconforming Use Permit related to a <br /> nonconforming side yard parking lot setback to the west along the railroad tracks. A Nonconforming <br /> Use Permit is required because improvements are proposed to the parking area along the western, <br /> north/south property boundary. The improvements include paving an already impervious gravel area <br /> used for parking and minor grading and asphalt repair. <br /> Also worth noting, this property consists of three buildings lying on three separate parcels, all having <br /> joint/shared parking arrangements. The property is essentially bound by highway right-of-way and a <br /> railroad. The only access point into the property is from the southwest corner of the site, off County <br /> Road D. Medtox Scientific, Inc. occupies all three buildings. Eight notices were sent out, there were no <br /> inquiries. City Planner Gundlach stated Staff recommends approval of both the Site Plan & <br /> Nonconforming Use Permit, subject to the following conditions: <br /> • The improvements are constructed consistent with the plans submitted. <br /> • A parking lot island within the northerly expanded parking area is curbed and raised so as to <br /> incorporate an over-story tree within the island. <br /> • All lighting is compliant with Zoning Code Section 11-010 (6). <br /> Commissioner Meyers questioned if the railroad track is elevated. Ms. Gundlach confirmed it is. <br /> The applicant stated the additional parking stalls would be used for employee parking. <br /> Lance Elliot,representing Elliot Design Build expressed his appreciation to City Planner Gundlach. <br /> Motion by Commissioner Nichols-Matkaiti, seconded by Commisisoner Alvey to close the Public <br /> Hearing. <br /> Motion approved7-0,-the-Public-Hearing-was-closed-at 7:31-pm. <br /> Motion by Commissioner McPherson, seconded by Commissioner Nichols-Matkaiti to approve staff <br /> recommendation <br /> Motion approved 7-0 <br /> 2 <br />
