process is similar to a Special Use Permit, requiring a public hearing and notification to the <br /> neighbors within 350' of the property. <br /> Section 8-063 outlines the criteria for determining a permitted use. Section 8-063 (1) states that <br /> the City Council shall not approve a proposed use as a permitted use unless it finds that all of the <br /> following criteria are met (staff analysis in italics): <br /> A. The proposed use is consistent with the City's comprehensive plan. <br /> Staff finds this criterion is not met. The Comprehensive Plan is the City's long-range <br /> planning tool used to guide the physical and socio-economic changes within the <br /> community. The document articulates a number of planning goals related to the City <br /> Center, which includes the property for the proposed re-entry facility. As discussed in <br /> the appeal section of this report, staff has concluded that the proposed residential reentry <br /> use is inconsistent with the Comprehensive Plan. The Comprehensive Plan categorizes <br /> mixed use under places to shop and interact. The mixed use designation correlates to the <br /> City's north gateway, which is the corner this property is located on. The <br /> Comprehensive Plan calls for this corner to be "developed such that the character of the <br /> expanded main street will carry from Highway 96 to the City Center". The objectives for <br /> this area encourage walking, biking, and driving, and to create viable shopping <br /> environments to satisfy the service needs of residents. Objectives also include providing <br /> a mix of uses and shared parking and to create compact centers and multiple use <br /> facilities that are complementary and of service to surrounding neighborhoods. VOA's <br /> proposed use is not compatible with adjacent uses and does not further the goals of the <br /> Comprehensive Plan. The proposed facility would not provide a service to the <br /> surrounding neighborhood, would not encourage walking or biking in the area, and <br /> would not help create a viable shopping environment. <br /> B. The proposed use is not listed as a special use in the district. <br /> This criterion is met. Residential reentry center is not otherwise listed as a special use in <br /> the MX district unless the Planning Commission and Council determine the appeal in <br /> favor of VOA. <br /> C. The proposed use meets the criteria set forth in Section 8-130. <br /> Staff finds this criterion is not met. A separate evaluation of the criteria in Section 8-130 <br /> is discussed below. <br /> D. The proposed use is not a residential use. <br /> This criterion does not apply in the MX district, which does allow some residential uses. <br /> E. The proposed use is suitable for any property in the district. <br /> Staff finds this criterion is not met. There are several characteristics of this use that <br /> could be problematic depending on the existing adjacent uses. For example, in this <br /> specific location there is a senior housing cooperative less than 100' away, a park of <br /> regional significance directly adjacent, and an existing paved trail that ties into the <br /> existing trail system in Long Lake Regional Park (as shown on the Recreation <br /> Development Map attached)yet there are security concerns with this facility that require <br /> certain monitoring devices.
