exhibits that should be mitigated if it were considered anywhere in the MX district. <br /> Depending on characteristics of adjacent uses and the proposed use of the property, <br /> those impacts may or may not be able to be mitigated, thus the use is not suitable for any <br /> property in the district. <br /> F. The proposed use is consistent with any general description in the code of the nature of <br /> uses for which the district is intended. <br /> Staff finds this criterion is not met. Section 6-510 outlines the intent of the MX district. It <br /> should be noted that the MX District code was created shortly after the completion of the <br /> 1997 Old Highway 8 corridor study. At the time, the MX District code was intended to <br /> deal with existing land uses, but also plan for future redevelopment along the corridor. <br /> The MX District code describes a goal to provide high intensity mixed uses consistent <br /> with the Old Highway 8 Corridor Study. In 1997 study mentions the importance of <br /> creating places where people can gather, play, live or work The proposed use will <br /> have little or no interaction with the public, or contribute to the City Center goals, thus <br /> not consistent with the purpose the MX district was created for. <br /> G. The proposed use is compatible with and complimentary to other permitted uses in the <br /> district. <br /> Staff finds this criterion is not met. The permitted uses in the district are intended to <br /> compliment one and other and further the goals of the Comprehensive Plan. The listed <br /> permitted uses include multi family residential, retail uses, professional office, funeral <br /> home, radio & television studio, clubs or fraternal or labor organization and public <br /> utility facilities. The proposed reentry center is not compatible or complimentary to these <br /> uses due to the following characteristics: <br /> • The security features that will be necessary to operate effectively <br /> • No interaction with the public or services offered to the public <br /> H. The proposed use is so similar in its nature and characteristics with respect to general <br /> zoning purposes that it is deemed in all practical respects to be the same as a listed <br /> permitted use. <br /> Staff finds this criterion is not met. As describe throughout this memo, the proposed use <br /> is a correctional facility that provides housing and limited supportive services. This type <br /> of facility is not listed anywhere in the Comprehensive Plan or the Zoning Code. As such <br /> the proposed use is unique that none of the listed permitted uses are similar. <br /> I. The proposed use will not have a detrimental effect on the economic viability of other <br /> permitted uses in the district. <br /> It is unclear whether the proposed reentry center will impact the economic viability of <br /> other permitted uses in the district. However, the senior cooperative has expressed <br /> concerns about property values and a sense of security. VOA has submitted background <br /> information on the siting of correctional facilities. Based on our limited review of the <br /> material, it appears that these studies are focused on more traditional stand-alone <br /> correctional facilities. However, the information should be considered. <br />
