RESOLUTION <br /> PLANNING COMMISSION <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL OF A SITE PLAN <br /> REQUEST. <br /> WHEREAS, an application has been made by Peter Murlowski to allow installation of a third <br /> driveway curb cut/access point at 1901 Sioux Boulevard per Zoning Code Section 11-020 (8) (G) <br /> which requires Site Plan approval for more than two access points, and <br /> WHEREAS,the procedural history of the application is as follows: <br /> 1. An application for a Site Plan was received on August 30, 2011. <br /> 2. No public hearing is required. <br /> 3. The Planning Commission voted to recommend approval on September 20, 2011. <br /> WHEREAS, the Planning Commission makes the following Findings of Fact with respect to the <br /> requested Site Plan(LP2011-001): <br /> 1. The property is zoned R-1, Single Family Residential. <br /> 2. The property is guided in the Comprehensive Plan for Low Density Residential. <br /> 3. The applicant proposes to install a horseshoe driveway, which will require installation of a <br /> third driveway curb cut/access point. <br /> 4. Zoning Code Section 11-020 (8) (G) states that no property under common ownership and <br /> used as a single unified use shall be entitled to more than two curb cuts or access points <br /> unless a site plan or site plan amendment for a greater number is approved by the City <br /> Council. <br /> 5. The Planning Commission considered the following factors in making a recommendation to <br /> approve the request: <br /> a. Sight visibility will not be negatively impacted. <br /> b. The horseshoe driveway will provide some additional parking and alleviate the need to <br /> regularly park vehicles in the existing driveway, which is almost entirely in the public <br /> right-of-way. <br /> c. The applicant will be required to meet the driveway setback standards and hardcover <br /> maximum of 50% of the lot area. <br /> NOW THEREFORE BE IT RESOLVED, that based upon the above findings of fact the Planning <br /> Commission recommends the City Council approve the Site Plan request, subject to the <br /> following conditions: <br /> 1. Installation of the horseshoe driveway shall be in compliance with the 50% maximum <br /> hardcover limitation for the entire parcel. <br /> 2. The two new driveway access points shall meet the following requirements: <br /> a. 20' setback from any right-of-way line of a street intersection <br /> b. 40' setback from another driveway on the same parcel <br /> c. 50' setback from another driveway on a different parcel <br /> d.
