Not Approved <br /> with MPI's future land use requests, collectively will result in a resolution intending to meet both the City and MPI's <br /> goals. <br /> Planner Gundlach stated as a point of clarification, even though the moratorium expired on July 23,2014,MPI still needs <br /> to secure land use approval prior to their expansion. Under State Law the City can take 120 days to review these land use <br /> requests. Thus, adequate time remains to process all necessary land use applications and ensure the planning process <br /> protects the general public's health, safety and welfare. Staff reviewed the proposed request in further detail with the <br /> Commission and recommended the Planning Commission recommend the City Council adopt an Ordinance which would <br /> rezone certain unzoned property from right-of-way to I-1, Light Industrial and R-1, Single Family Residential as depicted <br /> on the Proposed Zoning Map. In addition, Staff recommended the Planning Commission recommended the City Council <br /> adopt the Resolution provided approving the Comprehensive Plan Amendment and re-guiding property from OSP, Open <br /> Space Preservation to LI,Light Industrial as depicted on the Proposed Future Land Use Map. <br /> Chairperson Howard requested further information on the difference between the guiding plan and zoning plan <br /> designations. Planner Gundlach described the differences between the guiding plan or future land use map and the zoning <br /> plan. She explained that the proposed light industrial zoning would need the land use map guided in the same manner. <br /> Commissioner Deick questioned why these parcels did not have a zoning designation. Planner Gundlach was uncertain <br /> but believed it was due to the fact the property was previously owned by the Federal Government. <br /> Henry Kerntop, 1140 Rockstone Lane,questioned what parcels were being rezoned. Planner Gundlach reviewed an aerial <br /> photo with the parcels that would be rezoned. <br /> Jim Yarosh, legal representative for Murlowski Properties, explained his client purchased the three parcels two years ago <br /> and has been trying to put them to use. He questioned why staff was proposing to zone two of the parcels R-1. He did not <br /> believe this was a practical solution given the proximity to the railroad and a Light Industrial use. He respectfully <br /> requested each of the parcels be zoned Light Industrial. <br /> Mike Murlowski,Belair Excavating and Murlowski Properties, indicated he was available for comments or questions <br /> from the Planning Commission. <br /> Commissioner Deick questioned the benefit of zoning each of the parcels I-1,Light Industrial. Mr. Murlowski expressed <br /> concern with having residential property abutting an industrial use. He believed the land would provide a buffer to the <br /> neighboring homes if it were zoned light industrial. <br /> Planner Gundlach explained that residential property could only be developed if the parcel fronted a public roadway with <br /> at least 75 feet of frontage.
